mary gutierrez with the san jose fire department. again it's a fire at a fraternity house near san jose state university. this is the camera shooting from far away. it's 11th street, a few blocks from the san jose state campus. the good news is all of the students are safely out of that frat house. we do have one injury to a firefighter to his hands. he was burned. but he was taken to the hospital this morning. we'll attempt to give you a live report from the reporter on the scene. >> it is 5:15. not quite las vegas but it is a hotel casino with glitz and it's coming to the south bay. garden city casino building in saff01 1 101 near the airport. the shell of the casino is called the matrix. it's up at the intersection of first street and brokaw. there are craigslist ads. the project should be done by december. it's 600 rooms with an indoor theater and restaurants. some new jobs to the area. >> california lawmakers taking a few days off to cool off before they return to the negotiating table to talk about the budget. they have adjourn

i'm joined with mary gutierrez at the san jose fire department. >> crews arrived on scene early thisng. when they got to the second floor they popped a hole in the second floor ceiling, heavy fire involvement already. >> reporter: that's when you started to use the ladders? it was unsafe to send firefighters up on the roof? >> no. we did an aggressive interior attack with hand lines with multiple crews putting water into that second floor ceiling area to try to knock the fire down. we did that for 45 minutes. it became unsafe. our battalion chiefs called a vacate order to vacate all the firefighters out there was because of the conditions. the fire went defensive 45 minutes into the fire. we have three alarms' worth of equipment, 75 firefighters. >> reporter: where do you think the fire started? >> preliminary reports from students inside said they smelled smoke. they heard the smoke detector go off. they went in the laundry room. they saw some flames at the vent of the dryer. and some of them actually went on the roof and saw fire on the roof and tried to put it out with an extingui

we want to bring in fire captain mary gutierrez, san jose fire department., are you there? >> yes, i'm here. >> can you tell us what happened and how many firefighters are there and all the details that you can? >> yes. the call came in around 3:30 this morning, south 11th street, it was the kappa sigma fraternity. a student reported seeing fire in the laundry room. when crews arrived on scene, they had heavy black smoke at the rear of the building. it's a two-story fraternity. when they got inside to the second floor and pulled the ceiling, they found heavy fire inside the attic already. crews did an aggressive interior attack for about 45 minutes. after that the order was called and the fire went defensive which means our firefighters are fighting the fire from the outside. none of the officers were injured. there were 28 of them inside at the time all occupants have a place to go, we've taken care of that, the red cross is not needed. we have one firefighter that got transported to the hospital about an hour ago with burns to his hands. this fire is at fo

. >> we had talked to mary gutierrez with the fire department who they believe that it started in the attic but they don't know how just yet. are they saying, it was a warm night. did the they have the air conditioning on? any theories? >> at this point of course it's way too early to determine what caused it. but you're right, the smoke was coming from the attic area. i should mention i did speak to the alumni, the gentleman here actually he maintains the house, he says that it is about 45 years old, and this is of course quite surprising, that they have done major improvements and upgrades so it's in apparently fairly good condition. >> thankfully that they had those fire alarms working to get those folks out. i understand some of the other frat houses are going to take in those students. kind of always brothers, the brotherhood remains, right? >> they all have a place to go so that is good news. many options. the frat house, this is like frat row, i believe there are about eight fraternity houses where we are this morning. they are all opening their doors, we've seen some of the fr
