amna: mary mccord, talk to us about the potential timeline ahead.ith did say that and he would like to seek a speedy trial. i need not point out to you that we are facing an election year ahead. is there anyway this trial unfolds before that election? >> i do think there is a way. i agree with jennifer that the reason the first indictment just named donald trump is an effort to make sure you are not dealing with multiple codefendants and all of their attorneys. i can make a pretty well educated guess about who some of those other co-conspirators are and jack smith made clear the government is still continuing to investigate. i suspect we may see indictments down the pipe. fright now, i think a couple things are possible. alvin bragg, the district attorney in manhattan, did state over the weekend that if he needed his trial date to yield to a federal trial, he was willing to agree to that, so that can open up some space in the spring before the mar-a-lago trial scheduled in may. i believe mr. bragg's case was scheduled for trial in march and the mar-

let's talk about with mary mccord, former united states attorney, for washington d. c.. and a former senior justice department official, she's also co-host of the fantastic and imported, prosecuting donald trump. also with, us symone sanders-townsend, former senior adviser to president biden's 2020 campaign, and the host of symone on msnbc. i'm so grateful to both of you for being with us this evening. mary mccord, let's start with you. the legal stuff, for a lot of reasons, is not set in stone. there are a lot of reasons why a trial could be delayed, the bottom line, is donald trump's attorney asked for the trial the january 6th trial, to be in 2026. and the judge said, you're not getting two years on this. you get a couple months. >> she also invited him to suggest other dates earlier than 2026. he repeatedly refused, suggesting that anything that made mr. trump go to trial before the 2024 election would've been a violation of due process, and would not entitle him to a fair trial. the fact that this trial date ended up the day before super tuesday, as you indicated ne

still with me are mary mccord and andrew weissmann. mary, let me go to you on this first.ck smith is looking for in the direct messages? >> so, the direct messages are interesting because i would not have necessarily expected that he would be using direct message functions. it appears either he, or someone else with access to his account was using that function. i would be looking at a number of things, like who is he having direct messages with? is it people who are responding to his tweets? are some of those people who showed up and attacked the capitol on january 6th? are some of them people who threaten election workers or election officials in these states, particularly the states where the pressure campaign was put on. what was he saying to them, if he was having those direct messages? the direct messages also could reveal intent. could it reveal knowledge? consciousness of guilt. it is possibly that he was direct messaging people in his own circle and it is possible that some of those might acknowledge some of the falsity of the things he was tweeting. we just don't

former doj official mary mccord says all of this is just part of trump strategy. >> i think this is reallytic. mr. trump is now the defendant in an ongoing criminal proceeding. and they are treating this as though he is still just an ordinary citizen, who whose rights cannot be restricted at all. and that is not just the way it works in the criminal law, rightly or wrongly, the law provides a showing of the requisite predicate cause. there could be restrictions on people that can be restrictions on their liberty. many, many defendants in criminal cases and up detained pre trial. there can be restrictions on their speech. and i think that is something that mr. trump and his attorneys so far are not really acknowledging. >> in addition to writing up that 29-page response, trump's lawyers spent their weekend work shopping potential defenses, guess where? on television. here's that one lawyer john lauro how he responded to a question about mike pence's testimony. >> he said the president asked him to violate the -- it's another way of saying -- >> he never said, no, that's wrong. a technical v

joining me now is mary mccord, former principal deputy assistant attorney general and msnbc legal analyste notes, mary, of this hearing, i was like, ooh, don't play with judge chutkan. all of her responses were very blunt, succinct, and definitive, but that last part i think is important because she seemed to be saying if you play with me, i'm going to make this trial earlier, and what the trump team wants is for the trial to be as late as possible. is that how you read it? >> absolutely. she says in many ways, the more inflammatory statements there are before trial, the more urgency we have to get to trial. and that's directly related to the type of rhetoric and inflammatory statement we have already been hearing from mr. trump. those have a direct impact on his base. they cause people to take actions. we did just see an attempted attack on president biden in salt lake city just two days ago or maybe it was yesterday. i'm losing track of time. but i think she's recognizing the threat, her other rulings, you know, being not as expansive as what the government asked but being very clear th
