or the other option for judge masipa, to acquit oscar pistorius. we don't know what she's going to say. she's called this the lunch adjournment and we are waiting if the court to to reconvene. unexpectedly fast, slicing through days of prosecution evidence, days of circumstantial evidence, discussions about screams heard by neighbors. discussions about even the contents of reeva steenkamp's stomach, and all that surrounding evidence, she has just said none of it is conclusionive enough to prove murder beyond reasonable doubt. murder beyond reasonable doubt. with me to discuss more, a lawyer here in pretoria. it was incredible the way she just went through -- we were here for weeks listening to hour upon hour of the intricacies of where the fans were in the bedroom. what neighbors said they'd heard, whether it was a man or woman screaming. why did it all fall down? >> well, it didn't, because what the judge has to do is consider everything in context. it's incumbent upon the prosecution as well as the defense to put a story. they couldn't be as brie

judge masipa will then decide whether mr. mpistorius will remain in custody or be out on bail. >> reporter: judge masipa in just the last hour has made it clear her verdict in this case. it has been going on for 43 days, six months overall oscar pistorius's murder trial and for the killing of his girlfriend reeva steenkamp. we learned today that judge masipa finds him guilty not of the murder of reeva steenkamp, but of culpable homicide. this is what she had to say. >> mr. pistorius, please stand up. the unanimous decision of this court is the following. on court one, 105 of 1997, the accused is found not guilty and is discharged. instead, he is found guilty of culpable homicide. >> reporter: so what that broadly means is that judge masipa was not convinced by the evidence that oscar pistorius intended to kill reeva steenkamp. we saw her going through yesterday a lot of the state's evidence, discounting it, saying it was not enough to prove beyond a reasonable doubt that he had murdered reeva steenkamp, and she went on to say

judge masipa sentenced someone for over 200 years for serial rape. we can't tell, though. can you gauge anything from her behavior in court so far? >> no, she's been playing such an objective role. probably on purpose. it's difficult to judge it. she's already found that the accused was actually in self-defense. because of those circumstances. so she can hardly ignore that when the sentence is imposed. so the killing happened during the course of that situation. so with that in mind. >> reporter: we talked when we were discussing this yesterday not knowing what the verdict was going to be about the public pressure on a judge and how much a judge has to ignore that, the clamor on a huge celebrity case like this, for there to be justice. and knowing what public reaction will be if a sentence is light. what kind of judge -- what can a judge do about this? do they have to just blinker themselves? >> they need to toe kus on tfoc case. she's had many years of experience. a judge is not supposed to read the papers today or watch the tv because it might slightly influence her. she

judge thokozile masipa said she believed pistorius shot his girlfriend, reeva steenkamp, by accident, mistaking her for a burglar. >> it cannot be said that the accused did not entertain a genuine belief that there was an intruder in the toilet who posed a threat to him. >> reporter: pistorius was also found guilty of negligence when his gun accidentally went off in a crowded restaurant. in a country still struggling with issues of race and violence, reaction to the verdict was swift. forensic scientist dr. david klatzow told us he was astounded at the decision and he believed the judge's interpretation of the law was wrong. was justice served? >> i don't think so. i think that there's a problem, and i think that it is a step backwards for a violent society where there are a lot of people out there with guns. it sends a very negative message out to the country. >> reporter: klatzow said he couldn't understand how the judge came to the conclusion that pistorius didn't intend to kill steenkamp after high feared not one but four shots through the bathroom door. but thokozile masipa said
