joining us now is san jose mayor matt mahan. mayor mahan, nice to have you back in studio. great to be here. sure. so let's let's kind of go over this. voters passed prop 47 about ten years ago, and now you're hoping the voters this november will pass prop 36. fair to say, this is kind of a tough on crime prop. well, really the goal is to get people into treatment. it is. it's a reform, not a repeal of prop 47. since prop 47 passed, we've seen a 52% increase in homelessness. we've seen retail theft spike overdoses have gone up dramatically last year in the state of california over 11,000 people died of drug overdoses, largely from fentanyl. the fentanyl crisis is new. as of prop 47, it was not the crisis that it is today. and it's pretty clear that we're failing to get a handle on the untreated addiction that is driving some of our homelessness, keeping people trapped in homelessness and the some of the retail theft that we're seeing. are you surprised governor newsom is against prop 36? you know, i can't speak for the governor. it's a little disappointing. i understand tha

the debate is now pitting san jose's mayor, matt mahan, against governor newsom. it involves a ballot measure that you'll have an opportunity to vote on this november. prop 36. if approved, the measure would increase penalties for some crimes, including drug offenders and retail thefts. it's being sold as a partial rollback of prop 47, which was passed back in 2014. the ballot initiative changed a lot of nonviolent felonies to misdemeanors. it would also force some drug offenders into mandated treatment. today, mayor mehan joined local leaders in sacramento campaigning, campaigning for prop 36. he says after talking with community members, it's clear that our current policies are not working. this puts him at odds with governor newsom, who is against prop 36. the governor says it will continue to fuel our prison overcrowding and would be too costly. mayor mehan spoke to nbc's robert honda on his way back from sacramento, just a short while ago, saying prop 36 is actually meant to force people into treatment. what do you think was the worst unintended consequence o

so mayor matt mahan is pushing back saying that this rush by the governor to clear unhoused people from state land really does risk just shifting people from one jurisdiction to another. the governor made that threat yesterday at an encampment in southern california, two weeks after issuing that executive order to take down encampments on state property. now statewide, over the last three years, local programs for the unhoused have gotten $1 billion a year. but now the governor is threatening to pull that funding from counties that are not doing their part. i'm here on behalf of 40 million californians that are fed up. i'm here because i'm one of them. i want to see results. this is not about criminalization. what's criminal. it's neglecting people that are struggling and suffering and dying on our watc. now, in santa clara county, the city of san jose has been working with valley water to clear and then ban encampments along creeks and waterways in order to avoid the pollution that could get the city fined. now, people who return will get a warning, then there's a $500 fine and up to 3
