a former general counsel at the federal election commission, cnn political commentators matt lewis and joan walshst start with you. the first question, i think, is does he have a legal foot to stand on here, and what's the point of it? >> well, the point of it is to delay. legal foot to stand on, yes, he can refuse to have trump testify and mueller can subpoena trump and it can go to the courts and if the courts order trump to testify, he can take the fifth amendment. i don't think he has a legal foot to stand on with the demand, with the idea that i want to know all the evidence you have and you have to prove to me that you have evidence he committed a crime before i'm going to talk to you. every defense lawyer would love to be able to do that for your client but you generally can't. i think this is about the fact that they don't want trump to testify, and they're just trying to throw up smoke screens. >> matt, also about public opinion, right? obviously, rudy giuliani, even quoted in "the new york times" suggesting that they're not going to try to impeach trump if public opinion is going agains
