in the past hours prosecutors have announced they will seek the death penalty against jesse matthew in case the case goes to trial. what can you tell us? >> it is certainly a decision that got the attention of everybody in court, not necessarily what we acted. but the commonwealth attorney saying that there was new evidence came to light, new forensic evidence that came to light in february that compelled her office to upgrade this for my first degree murder case to a capital murder case. she would not give any details as to what the evidence is, only saying that jesse matthew was served the indictment this morning, and this was evident that came forward. forensic evidence came and propel case to move forward. he had been facing first-degree murder charges after hannah graham's disappearance in charles phil. her remains were found five weeks later in october in a rural part of the county. he was arrested a few days after. he was arrested in galveston texas. talk about this new texas, if the question as to why this question decision was made. here's what she said went into the decision-

matthew couch was 15 years old when he was hit by a mini van in march of 2013. the driver took off and left matthew with a serious head injury and a number of broken bones but after four surgeries rehabilitation and the help of chop matthew made a full recovery and he's living in life as a normal teen. the community played a big part in the healing process raising money for his family during their time of need and today the family is giving some of it back back. >> that money we're giving back to children's hospital for another family, you know, for -- i think we'll give three different areas of the hospital. for children's care and medical issues for kids. i want to leave it up to them where it's most needed. >> ed and matthew presented a check of $10,000 to the hospital today. they're also donating $5,000 for -- to friend who has breast cancer. >>> many of you pay your taxes with the expectation your personal information will be safe. >> wouldn't that be a nice thing, right? for more than 100,000 americans that is not the case. that's just at number we know of
