when the victim might point out jesse matthew as her attacker. defense attorneys charge that detectives guided the victim to media coverage on the internet after matthew was arrested last fall, enabling her to identify him. defense attorneys say in 2005, after the then-26-year-old was grabbed and raped while walking home from a fairfax grocery store, she had only a vague description of her attacker. but she testified it wasn't detectives who directed her online after matthew was indicted for her rape. she said it was her own curiosity that drew her to look in october and see one picture of matthew. asked the prosecutor, did you tell detective boone that the hair was different but the face was familiar? yes, she replied. the judge ruled there was not enough evidence to show police had tried to influence her ability to identify matthew. she will be able to answer that key question at trial. now, defense attorneys also made a last-ditch effort to continue the trial. that, too, was denied. trial begins here on monday of course, just the first to face

matthew is charged in a 2005 attack of a fairfax county woman. he's facing attempted capital murder, sexual assault and abduction. he's also charged in a separate case. you may remember in the death of uva student hannah graham. yesterday we heard from nine witnesses, including d.n.a. experts who testified most of the afternoon. the prosecution also said the d.n.a. evidence taken from the victim's finger nails when she scratched her attacker matched jesse matthew. the defense, however, pointed out that police interviewed more than a dozen suspects before arresting matthew. the nurse who collected that d.n.a. also testified about the victim's extensive injuries on her knees, chest, neck, feet, nose and genital area. we asked the commonwealth attorney about how he felt the trial was going so far. this is what he said. >> we're moving along rather quickly so that's a good thing. >> reporter: will you be finished with presenting your case this week? >> i think it's going to end a lot sooner than expected. i really do. we're sort of flying through the

they will be the ones to determine jesse matthews' fate. matthews charged in a 2005 sexual assault. prosecutors say he attacked a woman in the city of fairfax allegedly assaulting her here not far from a middle school and giant grocery store. he is aaccused of trying to kill the woman, too. it wasn't until hannah graham's abduction and death in charlottesville did matthews emerge as a suspect in the fairfax case. investigators say dna linked him. in court today a judge and attorneys spent hours questioning potential jurors, trying to find anyone who has biases and, helps couldn't give matthew a fair trial. andrew geraci's father is a fire marshal. >> my father works for the maryland state fire department as a fire marshal and is the maryland state fire marshal, bias toward people in law enforcement and their testimony may affect a criminal case. >> reporter: the judge excused him along with several others, seven men and seven women among those remaining. at no point during today's first day of trial did the the alleged victim point to matthew and say say -- [ inaudible ] in 2009. ma

jesse matthew walked into the courtroom again this morning. he appeared more tired today more gloomy. he immediately looked at his father, who was sitting in the public gallery portion of the courtroom before he took his seat in front of the judge. elizabeth ballard, a forensic scientist from richmond, was the first witness today, the expert who developed the dna profile of jesse matthew and that evidence matched the dna found under the fingernails of the fairfax county woman who was sexually assaulted near the county 10 years ago. at one point the mathews defense team asked the judge to drop the charges, arguing that two and a half days in the commonwealth has not been able to prove that matthew was the perpetrator that night in 2005, saying that dna evidence is all they have and it is simply not enough. the description was off, the sketch look nothing like him, no eyewitnesses. the victim in this case testified earlier this week that the attacker told her -- i will kill you if you scream again. minutes ago after hearing that argument the jud

will kill you if you scream again, those were the chilling words from the alleged victim of jessie matthew as she described how he beat her and sexually assaulted her ten years ago. testimony resumed this morning in fairfax county. peggy is live with more, and peggy, fighting back by the victim yielded some critical evidence in this case? >> reporter: the absolutely. she scratched the attacker, and it's that skin collected from under her fingernails is what police say gave them the dna profile that matches the defendant, jessie matthew. now, we've heard from four witnesses today, three police officers, one detective is on the stand. we heard from a nurse who did the examination of the victim that day, take a look at the video of the nurse walking out after testifying today. nurse mary lamb williams said she does not remember the victim, but referred to her report. the jury saw pictures of the victim in the hospital. the nurse said the victim had multiple scratches on her face and legs. neck was red, and genital area was swollen, red and bleeding. the nurse collected hair, mouth swabs. adva
