charles: we know they're not going to let it go, matthew. again, corroboration by comey that indeed he was told, he told president trump more than once, on three occasions, he was not the center of an investigation. i guess it might give back to the situation with michael flynn and how you parse these words. hope you can see your way clearer to letting this go. how do you see it? >> i see it similar to that. what i also see is what jim comey did at the time. he admits he didn't report it to higher-ups which would be inference he didn't believe the president was trying to obstruct justice, and in his prepared testimony that jim actually says that the president, you know, wanted to know if anybody in his campaign or his administration had done anything illegal and did want those pele fred out and potentially prosecuted. so i don't think this looks anything like obstruction of justice claim or even impeachable offense. charles: matthew, what do you make of the comment that comey said that he thought it was an effort for me to ask for my job and

here with me to discuss the high stakes, we have senior legal analyst jeffrey toobin, matthew whitaker and gloria borger. jeffrey, let's start with a story that's been breaking in the last day or so, which is that according to chris ruddy, a friend of president trump's, it's possible that president trump might assert executive privilege and fire robert mueller, who is the special counsel investigating the russia investigation. >> and that's where today's earlier hearing comes into play. rod rosenstein testified before a different committee and he was asked about this because this really goes to him. the president cannot directly fire robert mueller under the justice department regulations. he would have to ask the attorney general to fire mueller. the attorney general is recused so it would be up to rod rosenstein. rosenstein was asked repeatedly about this issue and said, i see no basis for firing robert mueller and i would only fire him for good cause. so i think he basically put to president trump today, if you want to fire robert mueller, i'm going to quick first. saturday night ma

matthew, stan by. phil, the fired fbi director james comey is set to testify before the senate intelligence committee next thursday morning. how much do we expect to hear from comey about his meetings with president trump? >> well, a detailed retelling, wolf. tha that's a course familiar with james comey thinking. we've seen bits and pieces of the details of what those meetings entailed from jim comey's perspective, from memos that he took and drafted during that process. but i think the interesting element here and obvious very different element is actually getting it in first person. it's worth noting there are limits to what jim comey can and will say. not just because particularly in the open portion of this hearing. you just need to look at what's going on behind the scenes. they've been talking with bob mueller trying to make sure nothing he talks about, no area he goes into would run cross wise with the investigation that bob mueller is now overseeing. but the expectation is that those meetings

i'm chris matthews up in boston.omey delivered powerful testimony yesterday about a president who lies, abuses power, and can't be trusted. and today president trump responded, defying and denying comey's written sworn account of what his then fbi director said he did, saying he would do so under oath. >> he did say under oath that you told him to let the flynn -- you said you hoped the flynn investigation -- he could let it go. >> i didn't say that. >> so he lied about that? >> well, i didn't say that.

his instincts are good. >> matthew, to you. if there was a recording that exonerated the president, don't you think we would have heard it by now? >> look. i'm not going to speculate on how or why the president made the remark he did about mr. comey ought to hope there are no tapes or when he would choose to reveal them. respectfully, i think the issue of the tapes is sort of a side show that's being created by the president to i think likely distract attention from what we -- at least according to former director comey's testimony, what we know to be the facts. i mean, i -- at the moment according to mr. trump's lawyer, there's a he said-he said but mr. comey has said his peace to the intelligence committee. it will be interesting to see if mr. trump stays true to his work to testify under oath about these matters. >> right. michael, to you, the president again teasing this about recordings yesterday at the rose garden. is this a strategy to distract? is he just still the great showman that he was in the 80s and 90s? what's go
