acting attorney general matthew whitaker. thank you for being with us and i want to start on the breaking news of the justice department memo. what does that mean and does it matter? >> yeah, it's good to o be with you tonight, brian. it matters in just the context that we find ourselves, which is that donald trump continues to be chased and harassed by the department of justice. i mean, this is going to be a memo that was generated by the prosecution team that did the mueller investigation that came up with the 400 plus page report that found that there was no collusion with the russian government and allege that had, ed that --alleged, you know, thr charged in a court of law were obstruction of justice and that'll be a memo that analyzes whether or not they should charge and prosecute. they declined to do that and did not recommend the department of justice pursue those charges and it's more logs on the fire and some day we'll be past this but right now it just seems to be that donald trump continues to be in the news becau

. >> harris: matthew whitaker, former acting attorney general during the trump administration is in "focus" now. let's begin with how this is carried out. i'm reading there are questions about procedures carrying out some of the boxes. i want to get into the nitty-gritty of this. were they supposed to go through evidence on site? i want to know. >> good to be with you today. one of the things that is a question is why send 30 f.b.i. agents to carry out 30 boxes? and how extensive did they actually search for the information they wanted or did they grab anything that wasn't attached to the walls? in this case, obviously if they had particular things they were looking for a subpoena could have easily accomplished the exact same retention and grabbing of the documents that a search warrant could. this is like you said unprecedented and really shocking. >> harris: so real quickly, when things are done wrong in this sense, what is the blowback against the f.b.i. or the d.o.j.? we don't know if things were broken here, if you will, in terms of rules and laws. but there are so many questions

matthew whitaker, former acting attorney general. the major complaint, right, from the right, from the g.o.p., is that the d.o.j. and f.b.i. in recent years have lost some trust. it appears to be a fair assessment. their belief is if you put out this affidavit, this document and 75% of it is blacked out, not exactly the best way to gain back that trust. your thoughts. >> yeah, i agree with my home state senator chuck grassley. i think the f.b.i. has a burden now to demonstrate that this isn't a continuation of the last seven years of them trying to get trump. ultimately the confident of the american people will be improved in the f.b.i. if they have more transparency. going to court to first of all block this affidavit and then if they present next week a completely blacked out document that looks more than a real affidavit it will be the -- increase the accusations that the f.b.i. is playing politics in this investigation. >> you talk about the redacted affidavit and jonathan turley made a good point and want to get your reaction on

will: let's bring in matthew whitaker to give us insight on this. what do we make of this?s us mostly things we already knew, where are we? >> reporter: one of the biggest challenges is that we haven't moved the ball far down the field from where we were. there is a desire and it should be required based on what doj has done previously for transparency and merrick garland owes the american people more than they are showing. i'm concerned because they released this affidavit somehow they are off the hook from providing more transparency. doing this search warrant 90 days before the 2022 election and resting on that on the attitude we can't talk anymore about this case because it is an ongoing investigation does put their thumb on the scale, very concerning to me and donald trump is right about the nuclear issue. we've seen these leaks out of the department of justice that have colored this case, none of it is supported in the affidavit. we need the department of justice to come clean and explain to the american people why this step was taken when it appears this had been mea
