chester police say they've made an arrest in last weekend's rape at a fraternity house. 19-year-old maurice yo' san juan martinez is being held. he's a student at west chester university. police say he sexually assaulted a female student at 4:00 a.m. sunday at the kappa delta rho fraternity house on south walnut street. that's the same fraternity whose penn state chapter was suspended over a web site full of naked and semi nude women and was shared without their consent. san juan martinez is not listed on the fraternity's public web site and it's not fear chooer if he's a fraternity member. >>> today was sentencing day for erica ginnetti. the high school teach here pled guilty to having sexual relations with a 17-year-old student. a judge ordered her to serve 30 days behind bars followed by two months of house arrest and then five years of parole and probation. she must also register as a sex offender. ginnetti was a math teach at lower moreland high school before her arrest two years ago. >>> here is the latest on a story we exclusively is reported on "action news" at 11:00 last night. all

. >> reporter: 26-year-old maurice tavares walked into southwest detectives with his girlfriend and hisy who says the youth basketball coach's back was against the wall when he opened fire on a crowded rec center saturday. anything you want to say to the kids at all. >> nope. >> reporter: 70 people were in christie recreation center on south 56th street. teens were on the court in the middle of a basketball game. investigators say tavares got into it with spectators and an opposing coach when things escalated and tavares pulled his gun firing once. no one was hit. >> 15 to 20 people were approaching him, some of them had their hands inside their hoodies, gesturing as if they had a firearm. others were calling his name cursing at him telling him that this is going to be it. >> unfortunately he doesn't abide by the rules he should as a coach in reducing conflict and creates a conflict. >> reporter: the detectives aren't buying self-defense. they say tavares could have called 911 or gotten help from the police district. >> what agitated him to that point is clearly wrong behavior an wrong
