i'm maurice dubois. >> i'm kristine johnson. the man appeared in civil court for killing three bears on his deck. >> the state said he killed the bears out of season and fired his season needlessly near homes. >> reporter: ronert ailing in court describing how he grabbed his shot gun after he heard his wife scream there was a bear in the back of their home in new jersey on the deck. the 78-year-old said he opened the sliding door, went outside to scare the bear off. face, aimed at his head and the bear fell. >> reporter: he said he killed the bear because he was afraid and then fatally shot the first cub because his bifocals made hem. he went inside, reloaded and shot and killed the club 30 feet away. >> reporter: he's fighting a summons for up to $2,000 for the death of each bear. he said he won't let new jersey make an exeam of -- example of him. >> when you went out there with that loaded gun, if that bear was not going to leave, you were going to shoot it. is that correct? >> if that bear was aggressive i would have to do so

i'm maurice dubois. >> and i'm christine. >> reporter: detective joseph lemm was a 15-year veteran of the nypd. he was serving with the air national guard in afghanistan and was killed by a suicide bomber earlier today. detective lemm was a dedicated family man and loyal member of the nypd. commissioner bratton praised his service to the city and the country. he was one of several american service members stopped at a patrol with afghan forces near bagram air base. a suicide bomber on a motorcycle packed with explosives drove into the group. the blast killed six members of the military and the taliban is claiming credit for the attack. black bunting hangs tonight outside the 50th precinct where the squad is based. detective lemm was a member of that squad. he was deployed three times, twice in afghanistan and once in iraq. and detective lemm leaves behind a wife and two children. so far this year, 20 american service members have been killed in afghanistan. this attack that killed detective lemm was the deadliest against u.s. forces since august. live in the newsroom, jessica schneide

good evening, everyone, i'm maurice dubois. >> reporter: traci johnson is live on the upper east side tonight with the very latest. >> reporter: maurice and christine, work out here continues more than three days later, take a look behind me. the first avenue here is closed still. the department of buildings will open back up. they're worried more bricks may fall from this east 64th street building's facade after they rained down onto the street below here monday night. things have gone from bad to worse, as upper east side residents living at 346th east 63rd street next to the building with the crumbling facade were told by the department of buildings they had to get out over concerns that bricks could crash through their wood frame building. the building super helped all 16 telephonents leave safely. >> i got called by the building department, that they're going to evacuate the building, and they needed me over here to make sure all the ten he wants are out. >> reporter: the department tells us the plan is to install protective netting to catch anything that may fall. this will be a

good evening, i'm maurice dubois. >> welcome back to the broadcast. i'm kristine johnson. the crime happened in brooklyn this time last year. today, the attacker was sentenced but not before facing his victim in court. new information now from cbs 2's brian webb. >> reporter: it was the drop kick seen across the city. a young woman carrying her two- month-old baby kicked to the ground so a crook could steal her cell phone. >> easy to say you're sorry. >> reporter: the judge asked us not to show video of the criminal in court. but 19-year-old alonzo brown's photo is widely available to the public. but he did say we do show the victim odile yeah orozco. she told the judge through a translator she has been scared to walk the streets ever since the attack. >> unless i have to go out, and i know he won't be able to be there, then i feel safe. >> reporter: alonzo brown's talking for him. she said he has always been remorseful even embarrassed by what he did. and even though he had a rough childhood, he never blamed anyone but himself. brown told the judge with little more than a

. >> i'm alice gainer in for maurice dubois. here's what we know right now. 14 people were killed and 21 wounded when the suspects, husband and wife, syed farook and tashfeen malik, opened fire at a banquet. tonight there are concerns farook could have become radicalized. sources say farook was in contact with people overseas with ties to terrorism. according to published reports, the couple met online. the fbi says that malik entered the united states on a fiance visa in july 2014 from saudi arabia. she had a pakistani passport. a search of their home uncovered 12 pipe bombs and more than 3,000 rounds of ammunition. investigators also found three connected pipe bombs with a remote-controlled device that apparently malfunctioned. >> it appears to be a degree of planning that went into this. nobody just gets upset at a party goes home and puts together that kind of an elaborate scheme or plan to come back and do that. that went into this. >> tonight investigators say they do not have any credible information to indicate that ther
