but ice water was running through judge mcafee's veins today. he understood the assignment and i thought he did it really well. he realized that this was not a hard discussion, not a hard issue about whether to sever these two defendants from each other. and he realized that they were going to go to trial together. i also thought it was interesting that he cautioned the state that trying all 19 by october 23rd was just gonna be unrealistic. but he was willing to hear them out, and as i have said before, notice and hearing or the hallmarks of the criminal justice system. he's gonna give them. that albeit on of abbreviated schedule. >> harry litman, what were you expected from the 34-year-old judge? and what else jumped out to you? >> i'm not sure what i was expecting, but i totally agree he was poised, he was relaxed, he was comfortable. he was very on top of them all. of the law. what jumped out to me was his firmness in telling chesebro, guess what, but you may not like it but you have no reason to be tried together. but then he's pushing back

judge mcafee told the state, be careful what you wish for.now you're ready to go but there's a lot of stuff you need to brief. so i want you to do it by next week tuesday because you need to answer some of these questions before i set a trial. >> greg, fani willis filed late today, put in some motions. interesting things here i want to get your thoughts on. in the motion she said based on the fulton county grand juries it is foreseeable they should be docked should their names be made available to the public. it would be undoubtedly be placed in jeopardy. basically what we're hearing from da willis, greg, is that there are cameras in the courtroom, but due efforts are made to keep these jurors anonymous and safe. is that one of the major concerns that people are thinking of downtown? is it one of those things where it's like, okay, that's part of it. we still think -- will they have to be sequestered. what are the thoughts about this idea of how to keep jurors safe? >> certainly, jason. there's a century old case law in georgia that allows th

late today, fulton county judge scott mcafee ruled that no information about the jurors in the rico case against trump and 18 others will be made public. that means no photographs, video, names and addresses. it's a move to protect jurors, and it comes as trump's language gets more ugly and ominous. trump intensified attacks on the press, and targeted, at aop military official, general mark milley. he noted menaceingly that in

and i trust that judge scott mcafee will balance between the public interest and the desire and need to keep these jurors safe. >> so katherine, we've talked about the upside of televised hearings. this could be a potential risk, right? you want to protect the jury, but what about the rest of the people involved in the case? part of fani willis's argument in that filing is that she's gotten threats, right? she used those as an example of what they could face. the attorney, the assistants, court employees, is there even a larger potential risk here? >> well, in terms of the jury, tv trials happen all the time, and you don't see the jury. usually you'll hear the clerk say and the jury is entering the courtroom, and the cameras turn to the judge. the cameras turn to the parties. so i don't think -- this ruling of the judge, i agree with lisa will be balanced. you will not see the jurors photographed or videotaped. that will be a direction by the court. they will be anonymous, the same way as lisa mentioned they were in manhattan on the civil rape defamation case. i don't know whether or

the judge here, scott mcafee, did not go for that. so, their trial is still set for next month, october 23rd. but mr. chesebro and ms. powell will be tried together. the judge essentially asserted that because powell and chesebro have never met, and that they would tell the jury that, the idea they would have any guilt by association issues is now and void. and judge mcafee is not going to waste court resources trying them separately. so, at the very least, mr. chesebro and ms. powell go to trial next month, which is a little over six weeks from now. but that brings us to the much bigger question posed today. do the 17 other defendants, including a one donald trump, do they have to go to trial next month as well? now, the prosecutors from the district attorney of fani willis's office think, yes, they should. >> judge, we contend that we must prove the entire conspiracy against each and every one charged. each and every one charged. so, the court, in the interest of judicious economy, would have to make the decision whether the court w

with scott mcafee considering motions from ken chesebro and sydney powell and their efforts to severy their case from the other co-defendants, but from each other. it was last week that chesebro's attorneys filed a motion saying he should not have to be tried alongside sydney powell. both are asking for a speedy trial, by the way, that he should not be tried next to sydney powell because they're not accused of operating the same scheme. powell's attorneys are arguing that powell, the only way for her to receive a fair trial is for her to be charged alone. both of these individuals asking for speedy trials. you know the former president along with ray smith and john eastman, former trump attorneys, they're asking for a delay in their trial. the judge also today will consider and will be expected to ask, i should say, fani willis how long it will take prosecutors to try all of these defendants together or if their cases are divided. so a big test today for fulton county's district attorney, fani willis. >> just to emphasize it for the first time, we will see it for ourselves and there

in and order today, judge mcafee court at the request, but said, no grandeur can be forced to answernterviewed. the defense lawyers must submit their questions for grand jurors inviting, to the judge, for his approval of the questions. prosecutors can object to those questions. the judge denied the defendant's request to current overall records generated by the special purpose grand jury that could with the and put you by station and into the case. but did not issue indictments. another one of donald trump's criminal codefendants in georgia, rudy giuliani, his under new pressure tonight with a criminal defense lawyer in new york who no longer represents giuliani, and is now suing him for one point $3 million in unpaid legal fees. joining us now is gwen keyes, a former district attorney in georgia, the neighboring county to fulton county. so we've all been learning some of the oddities of georgia law relevant grand juries and now there is the possibility, and it's only a possibility, of grand jurors being interviewed. it might be that none of them agree to be interviewed. and then the

and that is largely because, as you can see in judge mcafee's order, and there is a huge body of casesses or witness testimony, that could be brought forth by a defendant, particularly if they're looking to impeach a witness. i believe the dea and her team has already offered to provide transcripts. but in terms of speaking to the grand jurors themselves, understanding anything about the deliberations, all of that has been protected by georgia law, literally for decades. so, i'm sure there are several prosecutors in the state that are quite concerned about the precedent that this might set. >> there was the grand jury, a four person who many of us will remember, who did grant an interview, including an interview to nbc news. and then there were some other jurors who spoke to the atlanta journal-constitution, did not have their names made public. they didn't go as public as the foreperson did. and what i'm wondering is did that experience and all of the criticism that that foreperson got, for, example for granting those interviews, might that inform their experience such that none of t

it seems to be judged mcafee and congressman jim jordan and other critics have forgotten who d.a.is, and what exactly she has accomplished in her time in office. so, allow me a moment to remind folks of her track record. we're almost 20 years in a prosecutor, fani willis has led more than 100 jury trials. she is an expert in r.i.c.o. cases and then, forget he prosecuted one of georgia's largest criminal cases involving a cheating scandal and the atlanta public school system. in fact, since becoming chief prosecutor, willis's office is, wilson's conviction right for the d.a.'s office has stood close to 90%. the conviction rights matter, because prosecutors only bring cases they believe that they can win. so, they said. so, look. why are folks and saying that fani willis is in over her head or she is biting off more than she can to? and why the special counsel jack smith escape any scrutiny for his strategy? he also is bringing a case against the former president. he seemed to avoid the same level of scrutiny. many folks just took jack smith at his word. that he knew what he was doi

is it going to affect how things proceed with judge mcafee, joyce?t to envision the logistics of this many cases being severed from each other? >> right, so the bottom line here, katie, is if you don't want to be tried with people you should not commit crimes with them. you don't get to sever your case from codefendants just because you don't like it or in chesebro's case, he says he and sidney powell never exchanged text messages or emails. that's not how this works. if you are part of a conspiracy, the presumption, is your cases should be tried together. although here, it's likely we will have two different groups. the early group, that wants a speedy trial, and a later group that wants more time to prepare. >> yeah, but, joyce assuming choose burrow gets his wears and doesn't actually get to try his case with sydney powell, which is what he wants,. he doesn't want to be with her. does that mean fani willis has to get up time and time again and prove the case over and over again for each individual trial? >> well, it would and that is one of the re

mcafee may be a young judge, but he is a former prosecutor. and he was very skeptical about the prosecution's timeline for the rest of the case. >> reporter: that's exactly right. for the first time, the district attorney said that she wanted to try all 19 defendants together. there have been so many questions about whether that is logistically possible. and the judge really brought that to the forefront today saying, look, i don't know if it's possible to do all at one time. and the timeline right now is october 23rd. sidney powell, kenneth chesebro will go to trial. and the judge needs to decide officially whether the other 19 defendants, including trump, will be there alongside him. he's asked for additional briefings, but we know other defendants have asked to sever their cases. anderson, it appears highly unlikely that we're going to see all 19 defendants do to trial on october 23rd. but one significant development we saw late today, the district attorney, fani willis, asked the court to issue protections for any prospective jurors. this
