that means that the president and mccabe are suddenly aligned.ws, especially in the face of an on the record denial from rod rosenstein. now, the president may discount both of their statements one way or another and decide i'm done with all of this, but it does set up an interesting sort of credibility assessment for two officials in this situation who both have a significant amount to lose, obviously the deputy attorney general far more than mccabe at this point who was fired months ago for misleading internal investigators. now, a source familiar with all of this, all of these sort of dealings makes the point that mccabe doesn't really have an incentive to lie at this point. he has already been fired, the president has already said everything under the sun about him so why would he make this up, but of course then other people push back on that, namely the justice department officials who say, but he did lie to investigators so who are we supposed to trust here? >> that is a lot of what we've been talking about these days. one of the things th

memo, and there is apparently no note in mccabe's memo about sarcasm. mccabe's lawyer put out a statement that didn't push back on anyone one's reporting saying, in part, he has no knowledge of how any number -- any member of the media obtained those memos. so where does all this leave us? well, first off, sources cited by multiple news organizations all seem to confirm that rosenstein made a comment about wearing a wire, sarcasm or not. that's a big deal. there are also multiple accounts about the issue of the 25th amendment being raised. it's just a question of how seriously it was raised. still a big deal. joining me now is "the new york times" matt apuzzo. he contributed to the reporting of their bombshell story, and pete williams, our justice correspondent. tonight's panel is also here, leanne caldwell, george will, and maria theresa kumar. matt and pete, i'm going to start with you. matt, this is your guys' bombshell here. as you might expect, we got a lot of questions also about your sourcing on this because there's a lot of angles to this. but l

in fact, rosenstein ordered the firing of andy mccabe, and andy mccabe is now also under a criminal investigationating to statements that he made to investigators about various events at the fbi. so there is some thinking in the trump camp and in the justice department camp that this is some kind of a plot to try to provoke some sort of chaos that perhaps if an inferno ensues, some people might be able to escape under those circumstances. that's what i think may be fueling the kinds of comments that you heard from sean hannity tonight. i think perhaps a more organic reaction from the trump folks is that they would be delighted to see rod rosenstein leave because somehow that would bring an end to the mueller investigation. >> jonathan, serious question. the president's choice of weekend venues bedminster, new jersey, does it presume or predict any type of behavior? >> not necessarily. i would say it's a place where he's very comfortable where he often brings close allies and advisers in to talk to him, a place where he's made a lot of decisions before. but he was planning to be in bedminster long

what's mccabe saying? >> kate, mccabe is not out of the woods yet. batting down this new reporting out of the "washington post" confirming a grand jury has been used in this case. he says his client will ultimately be cleared and charges will not be brought. i want to read a little bit of a statement that mccabe's attorney gave to us. he says, this leak about a procedural step taken more than a month ago occurring in the midst of a disastrous week for the president is a sad and poorly veiled attempt to try to distract the american public. he questioning the timing of the reporting, but not denying a grand jury was used. the use of a grand jury like this, a federal criminal investigation, is routine. it's about as routine as having a prosecutor on the case. it does show that the u.s. attorney here in d.c. is taking it seriously. she's not just paying lip service to the inspector general's referral that mccabe lied to investigators. of course, mccabe denies it, that he did not wrong. we will wait and see how this gets resolved. >> absolutely. thanks, a

rosenstein and mccabe were arguing. what do you want me to do, wear a wire? two officials say the remark was made sarcastically, according to what this official tells nbc. there's a brief reference to it in a note about the meeting that was written by mccabe. the official says the notes about the same meeting taken by lisa page don't reference it at all. and rosenstein didn't raise it, this person telling nbc, the notion that he would want to talk about discussing this with kelgly makes no sense. he didn't know kelly then. rosenstein had been in the post three weeks, kelly was not a big player in the trump white house at the time. as a doj lawyer, rosenstein would know it takes a lot more than just some cabinet members to use the 25th amendment. you need a super majority in congress. the republicans are in charge there. this story is contested by the people involved. there's no doubt about one thing. this now lives in the white hot center of the controversy over what trump's going to do about a russia probe that is heading for the white house. donald trump's

we won't know that until we see the mccabe memo. >> bill: the mccabe memos.mbers of congress have been trying to get the mccabe memos released since about the spring of this year and based on our reporting they were told a couple months ago by the deputy attorney general and others they would not see these memos because of classified information and the needed secrecy surrounding special counsel robert mueller's russia investigation. the mccabe memos were a series of memos drafted by the deputy attorney general andrew mccabe and they memorialized conversations with comey. comey was documenting meetings with the president and have a debrief with mccabe. what we know from our reporting and the reporting of the "new york times" that broke the story at the end of last week that these memos also documented meetings after comey was fired and what "the new york times" alleged was a comment made by rosenstein about the 25th amendment and wiring the president. the deputy attorney general, bill, indicated that this was a sarcastic comment and that he never seriously di

so, first of all, rosenstein was involved in the decision to remove mccabe and, you know, mccabe andmccabe who was acting director in the period after jim comey was fired and these -- this period was one of a lot of chaos and a lot of machinations between the justice department and remaining fbi leadership leading up to the announcement of bob mueller's appointment as special counsel. we know that a lot of crazy things happened in that period of time and, you know, now andy mccabe who was dismissed on the basis of an inspector general report about false statements on an unrelated matter, mccabe is now facing a criminal investigation. so i think it is reasonable given that this material is not available to the white house and so a lot of people are assuming that this is a white house leak of material designed to set up the firing of rod rosenstein, but i think, in fact, the material must have come from somewhere within the justice department or the fbi or somewhere that is -- actually has access to this material and -- and i think it's reasonable to hypothesize -- i don't know for sur
