today, 39 year old duncan mccrary, the third, faced a judge. investigators say the florida man drove about nine miles the wrong way on highway 85 in san jose at speeds of about 100mph. ultimately, he slammed his rented pickup truck into a tesla carrying the mother, rebecca olson, and her 14 year old son, charlie. mccrary suffered what the da calls relatively minor injuries. he did not enter the courtroom today for the hearing, but could be seen in a wheelchair in the hallway. district attorney jeff rosen says mccrary was driving under the influence and acting recklessly, both in and out of that truck. he was driving. we don't know the answer. at this point as to why he got out of the car at one point and then got back into the car and continued driving at excessive speeds against traffic. that's something that will investigate and try to get an answer for. i don't know if we ever will know that answer. prosecutors also say mccrary had close calls with other drivers before the deadly crash. he will return to court on november 7th. also tonight,
