now we're going to send it over to scott mcgrew. scott, i know you sat in on much of this witness testimony. the jurors have a huge task ahead. >> i've got that jury form or an exam of it here. put yourself in their place for a second. this one asks for each of the following products, has apple proven a preponderance of the evidence that samsung infringed on claim 19 ever the 381 patent. then there is a list of cell phones so. the jury has to see if it captivates in the jury room. they have a cell phone there that says yes or no, it doesn't and check the box. then the next cell phone and the next cell phone. and on and on. and they have got to do this over and over. that's just page one. then they have to decide about the 1 t 915 and as you know, the 163 patent. go down the list again, yes, no, yes, no. and then off to the next page and so on. then they have to come up with damages. these are just regular people so it's going to be a terrible job. this is why the judge in the case has asked over and over that the lawyers just settle

scott mcgrew says it's what didn't happen. >> that really is the right question to ask.oday was the day the lock-up on yelp shares ended, the day when investors, the inside investors, could sell if they wanted to, but it appears they didn't. now, remember, back when facebook saw the end of its lock-up, shares in facebook cratered because so many people sold. and if you were a cagey investor you might have expected the same to happen at yelp so you sold short. you expected the price to go down. what i think we're seeing in this massive price spike are all those short sellers panicking and buying shares they need to cover their short position. turns out yelp is no facebook. another sign we're that much closer to another iphone. apple has started to offer cash back for ole iphones, and old would include the iphone 4s, which most of us would consider the brand-new iphone. more than $the 00 for a 16-gigabyte model in good condition. the rumors are the next iphone will be announced early next month. >>> voters off the coast of southern california were treated to a very rare ap

business and tech reporter scott mcgrew just walked out of the courtroom number five at san jose's federal court. you were there front and center. what can you tell us? what's the latest? >> reporter: jon, i'll tell you this, when jurors walked into the courtroom this morning at 9:30 in the morning, they had no idea they were about to be exposed to 100 pages of jury instructions. and after that's done, they've got themselves four hours of opening -- or closing, rather, arguments both from samsung and from apple. now, the judge in the case has said about every half an hour everybody stand up, move around a little bit, because in her words, i need everyone to stay conscious. it is that boring, to be honest with you. now, jury instructions are fairly common and usually fairly short and fairly interesting. these are neither short nor interesting, and i'll give you an example. item 22, the definition of the word "involve." that took several minutes to figure out what "involved" meant. there was another one, the definition of the color black. and jurors are having to sift through all of this. an

here's scott mcgrew with this morning's business and tech headlines. >> good morning. hewlett-packard will likely report the largest loss in the company's history today after the closing bell. hp is the largest maker of computers in the world, but that means really very little if people aren't buying computers and are buying ipads instead. hp's in the midst of an 8% layoff and will have to set aside money to compensate for the poor return of a different company it bought recently. >>> paypal has signed a deal with the discover network to allow you to pay with paypal any store that takes discover. instead of swiping the card, you'll be able to use that same credit card machine to type in your mobile phone number and a special pin and pay at the mall that way. you can already do this at home depot and a couple of other chain stores, but today's announcement widens paypal's reach to any store on the netwo network. the company says it should be in place by the end of the year. paypal's parent company, ebay, is up about 4% on the news. back to you. >> okay, scott. thanks. >

and scott mcgrew says that could mean higher gas prices. >> well, good morning.ssentially none of the patrol yum we use here in california comes from the gulf. we get a steady supply from canada, mexico, quite a bit here from california. but a reduction in supply in one place is still going to cause higher prices in another. we could see higher gas prices for speculators who really set the price have actually driven oil prices down because they think the federal government will release barrels from the strategic reserve, which is, after all, why we have the strategic reserve. if you do want higher prices, how about apple? shares in apple hit a brand-new high this morning as investors got their first opportunity to react to friday's verdict in the san jose federal court. the patent trial apple wins, samsung loses. apple wins more than a billion dollars. but that could actually be tripled under american law. today's jump in share price adds $18 billion to market capitalization for apple. and how well have these shares done in, say, the last three months? if someone

scott mcgrew says the golden gate isn't making much gold. >>> good morning. yeah. we've talk about how the bay area seems like an i labd when it comes to the economy. when you consider california as a whole, though, we have the third highest unemployment in the nation behind nevada and rhode island of all places. california's unemployment rate 10.7% according to the latest data, with 25,000 jobs added last month, far above the nationwide average of 8.3%. little bit of good news, it is the 12th straight month of jobs gain. as i mentioned, bay area gaining jobs more quickly than any other area in the state. that's some unusual bad news this morning from mountain view where coupons.com was structured and 25 people don't have jobs any longer. the spokesman at the company says the engineering department was particularly hard hit. >>> every penny lost in facebook stock today means a new low. the stock trading about 3.5% lower this morning, this a day after the end of the first lock-up where the early investors could sell stock if they so chose. another lock-up ends in no
