scott mcgrew says the death has been called a suicide but m.i.t. wants to know what role it may have played. >> schwartz was a very young and well regarded computer programmer. invented the rss system. he also was accused of breaking into a closet at m.i.t. and hooking up a laptop into the school's computer system to download millions of academic studies and papers. the u.s. attorney's office brought charges. schwartz faced decades in prison. despite the fact the publisher of the academic articles actually opposed the charges. m.i.t. this morning issued a letter to students and faculty saying it would look at its own behavior but came to the conclusion right in the letter itself that the school did not speak up against the prosecution loudly enough. the u.s. attorney's office blames schwartz for millions of dollars worth of academic papers stol even though many of those papers were available completely for free. >>> in happier news this morning, looks like markets will start monday well. let's turn to seema mody live at cnbc world headquarters. goo

scott mcgrew joins us from the newsroom now. apple set the pace in the tech industry for so long. is the drop in profit the real concern here or is it that other tech companies are starting to catch up to apple and could soon outrun it? >> one cause it is other. there is genuine concern apple is falling behind other companies. particularly samsung in attracting new young customers. for all the anguish we are talking about with apple it will still be the world's most important company no matter what it's going to report it made an incredible amount of makeup. we're sure of that. the fear is the rocket-like growth is slowing or reducing itself. blumberg speculated apple may make more profit this quarter than last. wall street doesn't like down arrows. we have anecdotal evidence about trouble at apple including last week sharp said it would make fewer screens for the big apple ipad. the concerns may not show up today. you slow down if future sales will slow. >> very interesting there. what does it mean for tim cook? is she still the right man for the job? >> absolutely. he's had chal

scott mcgrew single moms will now have to pay $70,000 in taxes. how's that possible? >> it's possible if you're "the wall street journal." the journal made a graphic showing a different number of americans all walks of life really what they'll have to pay in taxes. the single mother there on the left who makes $260,000 a year will have to pay about $70,000 in taxes. you see her sad face there. now the retired couple on the right who is scraping by at $180,000 a year also features. you'll have to feel bad in the lower right for mr. and mrs. average. they are trying to raise four children with an income of $650,000. that is only $54,000 a month that they have to get by on. analysis which ran a week ago in the journal is getting online attention this morning. lots of people assuming it ran in the onion, it's "the wall street journal." intel reported profits last night either good because they exceeded expectations or they're bad because intel clearly dealing with very quickly declining chip demand as fewer people buy computers. intel also says it will invest millions in

scott mcgrew has been looking into the problems with the dreamliner. airline says it's not concerned? >> it points out the particular aircraft on its way to san jose right now due in just after 9:00 a.m. has been in use for more than a year. there are concerns about the airworthiness of the boeing 787 in general nicknamed the dreamliner. the model was delayed for years at boeing factories. in the last week or so we've seen several problems with 787s at a variety of airlines with a cracked windshield, fuel leak in boston and not the kind of publicity the airlines want. here's ana spokesperson last night. >> that is not our company. that's different airlines aircraft. we don't have any comment. >> in fact ana did have problems with 787 after that interview just hours ago including a cracked windshield in japan. now ana flight 1076 just north of hawaii right now due into san jose at 9:19. it will then turn around and head back to japan at 11:00 a.m. at 6:30 our time, transportation secretary ray lahood will have a press conference about the problems with

scott mcgrew joins us in our newsroom with analyst.morning. >> 155,000 jobs were added to the american economy in the month of december. that gives us an unemployment rate of about 7.8%. now, this still leads us 4 million jobs short of the american economy we saw before the huge credit crisis a few years ago. but it continues to be good news. december a very tough number to crack because december is such an odd month. remember, we're always looking one month back. december you have lots of temporary jobs, holiday jobs at the mall, what not, a lot of people traveling as well. again, 7.8% on the unemployment rate in november it was 7.7%. don't consider that a tick up because economists have since changed their mind and called november 7.8% as well. this is neither good news nor bad news. it just is news and december is a bad month to try to figure this out. we're still 4 million jobs short of where we were just a few years ago. >> still a lot of work ahead. all right. thank you very much for the update. we can tell you governor jerry bro

scott mcgrew said apple investors were crushed when the sales of devices did not live up to analysts expectations. >> good morning. apple fell more than $53 a share this morning following that disappointing financial report. actual revenue honestly quite good. analysts expected apple to sell more devices than it did. the 10% slump in the stock took billions out of apple's overall worth, what we call the market cap. apple is so big, so huge, the value of its loss this morning is bigger than the total gdp of afghanistan and bolivia combined. this is just today is bigger than the entire value of hp. now one interesting bit, apple said sales of the mac computer dipped cannibalized by the ipad. if you are going to be cannibalized, you may as well be cannibalized by your own company. the markets reacting to netflix this morning. a positive financial report. microsoft reports this afternoon. i want to give you one thought. that is when people say netflix, apple and microsoft in the same sentence. i put together this chart. this is planet apple right here. microsoft is much smaller. call it

scott mcgrew says along with returning your books, just watch more tv.joins us with tv gadget friday. scott, the tv is backwards. what's going on. >> it is. forget books. let's talk about television. if you are familiar with internet enabled televisions that can scream net flicks, hulu, you don't have one you can hook up. now manufacturers are shrinking the technology down to a stick. here's a close up. it's called the smart stick from a company that is powered by google's android bringing internet connection to your television. if hulu and netflix require a subscription but they are such good services particularly hulu. it's well worth it. a few bucks a month. the actual stick is about 50 bucks. all it does is plugs into an open hdmi port on the back of your television or on the side. there's a little bit more hookup and setup but that's the important part. i don't know if i'm a huge fan of this particular model. i had some trouble with it. the concept is excellent. the internet and internet enabled television can all be in this tiny little box. >> so c

scott mcgrew, they have a special name if it happens twice. >> yeah, they call that a recession, two quarters of negative growth. we won't know about the second quarter for a couple months. let's look what we have today. the u.s. economy contracted by 0.1%. not a lot, but it is negative growth. much of that seemed to be the lack of defense spending as we wind down two wars. that number does not include sequestration. those are the huge defense cuts we'll see if the fiscal cliff isn't solved. cuts that will make the cuts we've got so far seem practically minor. nor does it include the result of high every taxes most of us are paying now that payroll taxes have gone up. bottom line, it's bad news, but at 0.1% it's not a disaster. but bigger problems are ahead. other news, facebook reports its profits after the closing bell today. scott budman will have a full rundown on that company's results tonight at 6:00. and research in motion, the maker of blackberry, has changed its name. to blackberry. makes sense. >> put the two together very quick. rob mayeda has a nice day outside. good news

scott mcgrew, you say investors don't get facebook. >> no, they don't. we've never dealt with a social network that makes $1.6 billion every quarter. there's nothing to compare it to to say, how does facebook compare to the rest of the social network industry. facebook made more money that analysts expected. the stock fell 6% on the hope this morning, currently down around 2%. wall street trying to digest yesterday's shocker that the american economy actually shrank last quarter. tomorrow we get the january jobs report. so there's a lot of numbers to chew over. and i don't know if you're remotely interested in this, but a new picture of a new remote from comcast called the x1. the big deal is -- the reason it's resonating with tech bloggers, it has 29 buttons. the current remote has 53. they've been able to cut it in half. we are owned by comcast. still i think it's pretty cool. the engineers tell the philadelphia inquirer, we don't use about half the buttons on the current remote. we should get it soon. >> fewer options, in this case, is better. >> abso

scott mcgrew, we were talking about the story before the show, a sad story all the way around. >> it is. schwartz took his own life over the weekend, marla. his lawyer, elliot peters told the "huffington post" this morning prosecutors were after publicity and newspaper headlines. congresswoman z ovrnlthse laugh man says it's time to update the hacking laws. some believe those laws were taken advantage of for downloading academic papers without per migsz. she proposed the idea to change the law on read it, the internet forum schwartz faced. originally he faced more than 30 years in jail, though it was reduced to a plea deal offer. the prosecutors including u.s. attorney carmen ortiz have become targets of criticism, so much so her husband, ortiz's husband, an ibm executive went to twitter criticizing the schwartz family on the day of the young man's funeral saying, quote, truly in their own son's obit they blame others for their son's death. the account has since been deleted. 28,000 americans have signed a petition to have that prosecutor fired. it takes 25,000 to require the white h

scott mcgrew joining us with analysis. >> good morning. the journal says apple cut orders from its suppliers for the parts that go into the iphone 5 by as much as half. apple stock is hovering around $500 this morning, down significantly. so why fewer iphones? well, perhaps increased competition from samsung. samsung, after all, offers all kinds of different phones. but apple offers just one. cnet speculates maybe apple is just too mainstream these days. it's the phone of the parents instead of the cool teen babysitter. >>> shares in facebook quietly gaining. the company has a press conference tomorrow morning. we don't know what it's going to be about just yet. perhaps some new news on mobile advertising. but facebook stock has quietly turned itself around. it opened this morning at $31 a share. that's a six-month high. and deutsche bank gave it an upgrade, as well. we'll find out more tomorrow. back to you. >> scott, thank you very much. >>> it's been announced today, toyota was the world's top-selling automaker of 2012. the car company

the labor department releasing the data for the month of december, which scott mcgrew admits is not his favorite month. >> yes, good morning. december is an odd one. the american economy added 155,000 jobs in the month of december. that puts the unemployment rate at 7.8%. now, why is december a tough one? well, it's because lots of people are traveling. maybe not seeking jobs. and there are lots of temporary jobs at the mall with holiday help and shipping as well. so it tends to be an unusual month. as far as that 7.8%, you may really it was 7.7% in november. is that a tick upwards? not really. because the economists have gone back in november and changed that number back to 7.8% as well. so it's really no news, but we often get that with december and the dow is responding with up 18 points. so again, no real effect on the markets this morning. we'll wait for the january numbers. back to you. >> thank you, scott. >>> governor jerry brown is developing a plan he hopes will keep his fiscal cliff deal from taking a bite out of california's budget. the deal signed by president obama on wedn
