they really lower the overall value of property for the entire neighborhood. >> reporter: mclaughlin put forward a controversial and novel plan using eminent domain to seize underwater mortgages from wall street firms and investors in hopes of keeping residents in their homes. eminent domain is usually invoked by governments to take private property for big projects like railways which are designed to serve the public good. but richmond is on the verge of being the first city in the nation to instead use the power to help refinance homes. richmond's city manager took the first steps in july, sending letters to financial institutions that manage the mortgages of 624 underwater homes, including the legrandes offering to buy the loans at what the city considers current fair market value. that's considerably less money than what is owed on the mortgages. if the offers from the city are refused, mclaughlin says the city may invoke eminent domain, seizing the loans, and then working with owners to try to refinance their homes at today's lower price, restoring some equity to the homeowner.

erin mclaughlin has the latest. >> reporter: lifting a ship the size of at "costa concordia" from its 100,000 tons of water-logged wreckage now slowly being pulled upright. engineers and welders monitored the vessel's every move. there is, after all, a very real risk the ship could break apart. >> she's a massive ship, a massive challenge, but when you add her to the slopes of gilia island and the two reefs she's balanced on it takes the project to a whole different scale. >> reporter: it's been 20 minutes since the costa concardia ran aground, killing 32 of the people on board. the massive operation to remove the wreckage began with steel platforms built below the water. cables helping to hoist the ship upright, and a series of enormous floatation devices attached to the ship's sides are designed to eventually help the cruiseliner float away to aer inby port. underwater debris from the tragedy still floats along the italian seabed an ominous reminder of the toxic stew still inside the vessel and environmental disaster if the salvage operation is not successful. removal of the ship is

richmond mayor gayle mclaughlin announced in july that her city was teaming with the san francisco investmentgage resolution partners to buy more than 600 city residents' mortgages that were underwater the state assembly has approved legislation that would require county coroners to report drug overdose deaths to the state medical board. the bill was drafted in response to an investigation regarding deaths from prescription drug overdoses. it found a lack of oversight by the medical board regarding overdoses cases. the bill will help the medical board track overdose deaths and assist officials searching for patterns. >> gov. brown has signed into law a bill closing a legal loophole that allowed a rape conviction to be overturned because the woman was not married. the bill fixes a state law dating to the 1870s that said impersonating a person's spouse to have sex was rape. the law now also includes impersonating a person's cohabitant, boyfriend or girlfriend the revision was prompted by a 2009 case in which prosecutors said couldn't file a rape charge against a man because the woman wasn't mar
