travis mcmichael had his cell phone, but greg mcmichael does not take his cell phone to him. right. this is really important, ladies and gentlemen. on february 11th, the 911 operator staid on the phone with travis mcmichael the entire time, right? if greg mcmichael had actually made contact with a 911 operator, what would have been happening inside the truck? he would have been on the phone with that 911 operator, going, yeah, he's going this way, he's going this way, he's going that way, okay? the fact that greg mcmichael was not on the phone with 911, giving them a play by play, tells you that travis and greg knew they weren't -- they had not called 911. travis knew his dad hadn't called 911. neither one of them called 911. they had no intention of calling 911. just like they went and confronted the homeless guy under the bridge and then called 911. just like they ran back down on february 11th, 2020, to the house, and then called 911. what do they do? go to do a confrontation, and then they call 911. greg mcmichael didn't even bother to take his cell phone with him. obviou

greg mcmichael pulled no trigger. could the state seek a conviction for malice murder as greg stood in the bed of the pickup truck on the phone with 911 as the fatal shots were fired? as a party to the crime. you were told about the law that the judge will give you. if someone intentionally helps or aids or procures or hires or assists in the commission of a crime, they can be as guilty as the principal, as the person who fired the shots, but what is so very different about count someone that it's malice murder. it requires the desire and the intent to kill, the deliberate intention to take the life of another human being where all of the circumstances of the killing show that an individual acted with an abanned and malignant heart. the state will have to be asking you to find that greg mcmichael advised or encouraged travis mcmichael, his son, to take the life of ahmaud arbery because that's what he wanted to do. for no reason other than to see that young man die and to see him die at hands of his own son, and to do

mcmichael up there yesterday.resting tactic, which was they really wanted to establish the defense did that mr. mcmichael was a well trained in law enforcement techniques, which i thought was an interesting decision because then, look, i think it ended up opening up what we saw today, what do you make of the decision of putting him on the stand, number one, and how did you think the prosecution did today, number two? >> this reads like a real desperation tactic. you don't put a defendant like this on the witness stand unless what you're hoping is that you can convince one or two jurors to hold out so that the jury hangs instead of convicting. this strategy that they pursued of bolstering law enforcement credentials was designed to give a effect to the defense that we expect to hear them talk more about in closing argument, that travis mcmichael and his father intended to effect a citizens arrest that, they had probable cause. that's why we heard that extensive conversation about whether he knew what probable cause

mcmichael will be brutal. if it were me, i would dig up every training officer he had ever had at the coast guard and have them talk about whether the picture he puts on the witness stand of someone who is fully trained is consistent with how he behaved when he was on active duty. i suspect that they may even open the door to bringing in some of the racist statements that mcmichael made on the day that he killed mr. arbery. this is a very perplexing strategy. >> i wonder, did the defense potentially see that they didn't have much of a choice here given the picture that had been painted of travis mcmichael, the racist statements as you mentioned, his mug shot, the video of he and his father and the friend chasing down ahmaud arbery. let's remember that ahmaud arbery was not armed, they were chasing him down with a car and a gun. is it possible the defense felt like they didn't really have much of a choice here, they had no real way to get any defense in given what was already out there, and this is what they ha

travis mcmichael was on the couch. greg mcmichael, you saw, he can't even see down the road.arrest. not present where any crime was committed. the suggestion that ahmaud committed a crime is based on what? not immediate knowledge. speculation. specu speculation. how do we know? because of the defendants' own words to the police. wanting to question ahmaud demonstrates uncertainty. hey, where are you coming from? they don't know where he's coming from. what are you doing? they don't know what he's doing. remember mr. bryan, what did you steal? they don't know what he's done. they don't know why he's out there running. they don't have immediate knowledge. they have no knowledge. they have speculation because he's running down the street. wanting to question ahmaud demonstrates a lack of immediate knowledge, which is required, required under the citizens arrest law. because it is required, that means this was not a lawful citizens arrest. remember what greg mcmichael said? did this guy break into this house today? i don't know. but, hey, law enforcement officers, i'm sure he mus

a bit of a surprise that travis mcmichael took the stand. we'd really heard from him was 911 calls or police bodycam video. but today he gave his version of what happened. >> i want to give my side of the story. i want to explain what happened. >> reporter: instead of invoking the fifth, travis mcmichael gave the jury a first-person account of what he he says happened the day he shot and killed ahmaud arbery. mcmichael broke down crying as he described the final deadly confrontation, captured on cell phone video, as a fight for his life. >> what were you thinking at that moment? >> i was thinking of my son. i know it sounds weird but that was the first -- that's the first thing that hit me. >> what did you do? >> i shot him. >> why? >> he -- he had my gun. >> reporter: on february 23rd, 2020 his father, gregory mcmichael, spotted arbery running from a home under construction. the younger mcmichael says he grabbed a shotgun and jumped into his truck with his father. prosecutors have argued that the mcmichaels and william roddie bryan chased a

greg mcmichael, the father of travis mcmichael, who was in that first pickup truck, is a former investigator for the d.a.'s office here in brunswick county. first, the d.a. in brunswick county recuses themselves. then it goes to waycross district court, the d.a. there recuses himself but not before writing a letter saying that the actions were perfectly legal. then it went to linda danakowsky and that's somehow she ended up taking the case. you have all of these outstanding that remain about how the local authorities handled this case. we talked about the two pickup trucks. those two pickup trucks were never impounded, they were never searched. there was never a crime scene made. there are photos of greg mcmichael, the former police officer, talking to the investigators at the scene of the crime. all of this is what raised the eyebrows not only of the family but of the family's attorneys and it's how we ended up with linda danakowsky giving that closing argument yesterday. >> let's go to nantucket. josh lederman, you have been following president biden. he has now released a statement about
