it is when we get through the medallions that are part of the pilot program. so we have gotten through the privately sold medallions of any buyers willing to sell at this point. excuse me, and the sellers. and we have also run out of medallions that were in the possession of the mta. we have no more to sell except that we continue, under the pilot program, we remain with the obligation of giving 25 more medallions to the list and we can sell about 25 more. we have sold about 30, and we have given away about 30. the pilot program will continue until those medallions that come to us through death or revocation meet that 60 and 60 requirement. there is no time limit. it will just continue until it runs its course. meanwhile, we have probably over 1000 taxi drivers that are eager and willing to purchase, and have no more medallions to sell. one of the things that begin this discussion, the people that have become disabled since the pilot program opportunity closed, we want to allow those people to exit the industry before the conditions make life very difficult. >

in 2006, he was given notice that he was eligible for a potential medallion.responded that he had not been driving his vehicle since 2001. as you are well aware, as an applicant for a medallion, you must be able to demonstrate that you follow the full time driver requirements. at the time, his application was two of the last three years of driving before getting a medallion career he responded by saying you had not driven. he was given a time waiver. what that would do it would give you one extra year to give you a chance to improve your driving and allow you to add an additional year of driving. he never responded. it read -- expired in july of 2007. after that, he was notified that there is a hearing and that he would be removed from the list. if he did not appear. he did not appear and was properly removed from the list carried and we were never able to get to the issue of whether this alleged disability would preclude him to obtaining a medallion. we feel he was properly removed from the waiting list. there are still 2800 names on that list, 16-17 years lo

as an aside, one of the things i really did not want to hear was the concept of medallions for these food truck, because i sat in at the very -- at the very beginning. that did nothing for us. the two things that focused my attention and has affected my decision making are the following -- first, our city agencies are expected to create a consentual atmosphere. i do not see that here. i see that it has not occurred. i think that agencies have been able to help focus, to help refine the legislation so that they wind up creating a greater amount of consensus. as an example, when we dealt with limitations on the number of restaurants on a street, when it dealt with certain types of restaurants that were in excess of four or six, depending on the time frame, they had to go through a different process. i do not see a process occurring here. i do not see the refinement that will be reflective of less discord. adding to that, when i look at the specifics of the cases, and we did see the findings -- excuse me, we saw reports. we did not see a lot of identification of whether or not there was

the removal on august 30, 2007 of the appellants name from the public convenience and necessity medallionting list. this was on the board called the chair calendar for the past four years awaiting the outcome of a lawsuit filed against the city in which subject matter was being considered. that litigation is now over and when contacted, the appellant indicated that he wanted to have this matter heard. an october hearing that was elected but after mr. martinovsky failed to submit a brief, the matter was rescheduled to this date. mr. martinovsky indicated he was unhappy with the hearing date but refused to suggest an alternative. during a telephone conversation late last week, he indicated he did not attend to appear today. i am assuming he is not here. with that, i would recommend that we call the department representative to give him an opportunity to speak. president goh: agreed.
