this is a project that's near and dear to my heart and when ed meese called and asked if i would participate in something that dealt with the problem that i saw as a massive problem, overcriminalization, something that as a former prosecutor, judge, chief justice has driven me crazy, because i had seen, when people want to beat their chest and show how tough they are, well, let's slap a criminal penalty on something. and so as you know, we talked about there may be 5,000 or so crimes. they're not in 18 u.s. code where they ought to be as a criminal code. and i had wondered why in the world have we not been able to clean this mess up before. and what i'd heard is that it seems like every time a project gets fired up to try to clean up the criminal code, that it ends up being a big santa claus christmas bag and people start trying to throw more and more in it and then overall, you lose too many votes and people go, i can't agree to that. wait a minute. i love the idea. i was on board but now you've thrown that in the bag. i can't agree to that. and then it loses the impetus and nothing gets do
