megyn: kelly's court is back in session. bombshell developments in the colorado movie massacre.ooter james holmes formally charged today with 24 counts of murder among a long list of other charges. attorneys also argued over a defense motion that is trying to discover who leaked information to the news media about a package that holmes sent in the mail to this woman. her name is dr. lynn fenton. she is the university of colorado psychiatrist who holmes now says was treating him. she is also a member of the university's threat assessment team, although we don't know that that's the capacity in which she was treating him. the package, addressed to her, apparently contained a notebook that outlined an attack showing stick figures killing other stick figures which raises the question what did dr. fenton and the university know about holmes before he allegedly opened fire, and can they be held responsible for it? joining me now, least lis wiehl and mark ieg lahr,. now we know he was under psychiatric care. we don't know whether she came into his life because he sought counseling for

megyn: "kelly's court" back in session.et today, the first lawsuit now reportedly has been filed in the colorado movie massacre. 18-year-old torrence brown was not injured when the accused gunman james holmes sprayed the aurora theater with bullets but his best friend is one of the 12 people that was killed. he is now suing the movie theater, the film studio behind the "the dark knight rises" and the doctors believed to have treated and perhaps even medicated shooting suspect before the attack. this is the theory but can they actually be held accountable for this? joining me now, former prosecutor, now defense attorney, arthur adial la and former prosecutor, now defense attorney, jonna spilbor. start with the movie theater. came in with the rest of the moviegoers, the shooter. gone out the exit. propped it open. gotten his gear, come back in the emergency exit and that is when the shooting occurred. >> of the three potential defendants the movie theater is probably most going to be on the hook. it will not be easy to collec

megyn: "kelly's court" is back in session. the trayvon martin murder case, or is it. prosecutors release 150 phone calls made by george zimmerman in jail. he's the neighborhood watch volunteer who said that he shot the 17-year-old martin in self-defense. new record insurance from a woman known as witness nine could spell potentially more trouble for mr. zimmerman. she tells investigators, in addition to the jailhouse phone calls, that her family has known the zimmermans for years and now she claims they were all a bunch of racists. >> just that i was afraid that he wasn't going to do the thing because the kid was black. growing up him and his family have always made statements that they don't like black people if they don't act like white people. they like black people if they act white. and other than that, they talk a lot of bad things about black people. megyn: joining me now, lis wiehl a legal analyst and mike eiglarsh, a former prosecutor and now a defense attorney. can we all agree this would never be allowed into eviden
