i'm megyn kelly. this latest case revolves around a man named eric garner who died over the summer after a confrontation with police in new york city. for hours now we have witnessed growing protests in new york and washington with marchers shouting about both the garner case and the decision in ferguson. right now we're getting reports that they are heading to the west side highway here in new york city. we are working to confirm that, but it has been quite a situation on the ground right beneath us. eric garner was tackled after he claimed -- a medical examiner ruled that death a homicide. but we'll get into what that actually means. you can see from the video an officer grabbed mr. garner from behind. his arm is around garner's neck. at least four people surround garner and bring him to the ground. garner repeatedly tells them i can't breathe, eleven times he says that. and he later dies. since the grand jury announcement this afternoon the crowds have grown louder and larger in new york. protester

i'm megyn kelly. we have new details tonight on what may have inspired the lone gunman who staged a dramatic hostage taking in australia that ended with lee dead including the hostage taker. he was a self-described islamic cleric who demanded police deliver him an islamic state flag as he held more than a dozen people at gunpoint. we will get to that later on in this broadcast. but first, tonight, we examine the controversial cia interrogation report from a perspective you have not heard. dr. james mitchell was approached by the cia in the months after 9/11, asked to develop a program to get more information from terror suspects. at the time intel suggested bin laden wanted to get ahold of nuclear weapons. and washington was very worried. before he was done, mitchell himself would not only help shape the controversial enhanced interrogation effort, but he was personally part of the team that questioned 9/11 mastermind khalid sheikh mohammed. joining me now, dr. james mitchell, who is a psychologist. d

bill: so megyn kelly with me now. megyn, good morning to you. >> hi, bill. how you doing? really appreciate your time, he said an awful lot in his interview. he wanted to remind us that al-qaeda wanted to decapitate the united states by trying to take out lawmakers in washington. that did not happen. did he say why or even how he developed this program of waterboarding? >> yes. he was in the air force for years and then working with the cia, and he's a psychologist. and so he had some expertise in these areas. they came to him and asked him to take a look at what's called the manchester manual which was being used by al-qaeda. it was based on information they had gotten from a united states soldier back when the afghanistan war was going on with the russians. in any event, they came up with their ways to resist our interrogation methods, and they asked james mitchell, dr. james mitchell, the u.s. did, to take a look at this manual and figure out ways to sort of counteract our own resistance techniques that al-qaeda was prepared to use. and then they figured out, okay, now

megyn kelly sat down with james mitchell.name, but he's retired air force psychologist. he's one of the guys who did the interrogation on the high value detainees, including khalid shaikh mohammed. on the heels of the democrat report, essentially said it didn't work and they did a bunch of illegal stuff. he was on with megyn kelly last night and said, look, i was in the room when the director of the c.i.a. and the top lawyer were talking about how it was all legal. so it was legal. he also said, even though he's the guy who administered the actual water boarding to khalid shaikh mohammed, nobody ever called him. nobody ever talked to him. so he's not a fan of the senate democratic report. and he said that khalid shaikh mohammed himself made it very clear that one day the liberal media would turn on the good guys and it was very prophetic. listen to this. >> shows al-qaeda and the al-qaeda 2.0 folks, isil, that we are divided and that we're easy targets, that we don't have the will to defeat them because that's what they know.
