joining me now is ari melber, host of "the point" starting in just a little bit here.stion out there was, did it unfairly target muslims coming to america? that data seems to show that the numbers went down precipitously compared to other groups. >> right. that's not a surprise to others who followed this. it further documents a natural consequence of focusing on regions that are muslim dominated or a muslim majority. legally, that doesn't end the question. take a different example. say, after 9/11, you pick a freeze only on saudi arabia, it would also that have co consequential issue but not targeting them. >> you've seen folks that are refugees and they are in limbo despite it being fairly clear that these two judges in these two states saying it is not in effect, the second travel ban. why might they be in limbo? >> you have the overall problem of the administration of these programs which are not just the simple turn them on and off. there's planning around what is expected to happen and it's fair to say it's been relatively chaotic throughout. the big difference h

ari melber, does this put them on more solid legal ground the way they've restructured and rewritten all the bullet points i was showing everyone? is it easier for them to defend this in court? >> it probably is easier. can you think of the previous ban which was a bit of a mess as having several points of attack. and the way that they have narrowed and clarified aspects of this similar policy, which is still to restrict immigration in various ways, probably has fewer opening lines of attack. they addressed the green card issue. they have explained themselves a little better on refugees and not singled out syria. and they have tried to go further to deal with what was -- is the remaining line of attack, which is to clarify in no way they say they meant to discriminate on the basis of religion and there's no religious anamous then or now. that gives them some defenses, although we except some legal challeng challenges, of course. >> the ban doesn't affect people who had a visa as of late january, doesn't affect people who have green cards. what happens next week on march 16 lt? >> the

ari melber remains with us. we have been using this word "recusal." it's a $5 word for a ten-cent meaning. that is, to take yourself out, to remove yourself and let other attorneys handle something, correct? >> that's correct, brian. recusal just means someone else will do the job. it doesn't tell you anything about the job, how serious or long will the investigation be, what will it probe or not. in this case it would basically signal, if the attorney general recused himself from the russia inquiries that there was some serious set of questions about his relationships or association with potential targets of the investigation. so if he is friends or too close with the people being investigated, it would look better under the recusal standard, to have him not involved in the case. there is federal law in this that refers to personal or political relationships as an example of when you should step back. >> we've known notable cases of recusal in the past years, where especially at the justice department it means something. it means i'm over here. the r

good evening, i am ari melber, brian is under the weather tonight. within the next hour, the president's ban was to take effect in the united states but it was not. >> the trump administration is playing in defense in high stakes. mounting concerns of the past republican healthcare plans. the breaking news is how the president's second attempt of the travel ban limiting immigration from six immigration countries just hit a roadblock. a federal judge in hawaii blocking the ban finding it to amount to a religious test of a violation of the first amendment. his campaign style in nashville tonight, the president responded. >> a judge just blocked our executive order on travel and refugees coming into our country from certain countries. [ crowd boos ] >> the only he blocked was a watered down version of the first order that was blocked by another judge and should never been blocked to start with. >> this is a watered down version. let me tell you something. i think we ought to go back to the first one to go all the way which is what i want to do all the w

we've got our whole team there, no norm, pete williams, and ari melber. chris, start with you. >> reporter: the most important thing that we didn't hear is what we heard on that call, they referenced a one-hour long call, emphasizing the fact they believe there is nothing wrong with the law that they put out, legally with the first travel ban. having said that they made these changes, significantly don't make major changes but there is one thing it affects when you look at the revised immigration order, you see it's 90-day hold on issuing visas, 120 days on refugee admissions worldwide. what they don't answer is what the strategy is going forward, how you present this to congress. already even while they were still speaking chuck schumer puts out a statement saying "a watered down ban is still a ban." they did make the point that the white house is going to be repeating throughout the day the rightful authority of the president to keep american people safe. having said that, then why they were asked why is there this delay until march 16th? you remember t

joining me, msnbc chief legal correspondent ari melber. what do they want to do? this is a restaurant saying they have been personally hurt and harmed by the special benefits, unfair competition, that the trump d.c. hotel has and the links to him as president, as he has not divested in its ownership. this is all about local business. this is different than some of the suits we've heard about on the travel ban or the so-called emoluments, the idea that the president benefits from foreign ma governments. this is a local case relying on local competition. they're basically asking a judge to come in and say it unfair for one company to be so linked and benefitted by the incumbent president if he won't divest. thus he should either divest or close down. this is really important for a third and final reason, hallie, and that is these people in the eyes of the law probably do have a good argument that they have skin in the game. the emoluments suit that was filed by people in the public community, they weren't really involved. these people can say, hey, we run a business

msnbc chief legal correspondent ari melber in studio. kelly, donald trump has a lot going on. there's russia, health care. do we expect we're going to hear him talk about this in michigan today? will we hear from him on twitter? >> reporter: well, i think the expectation judging by what we've learned watching him over the last couple of years and more recently in his sort of white house mode is that the president will likely take some shots at the political environment, the media, certainly. a subject like russia, he has really been quiet on that of late. because he has a domestic agenda that will unfold in detroit, it would be harder for him to find a way to do it. he is someone who knows how to turn the moment, direct a narrative. he's had long success at that. there are a lot of issues here. also we're in the environment where there are things he's trying to accomplish. there's a budget tomorrow, the health care law. all these different things, none of them easy to handle. and the president is in sort of the crosshairs of politics and populism on some of these topics. makes

let me switch subjects and go to ari melber, who's been patiently waiting with us. this subject, the executive order on immigration, the new one, we learned an hour ago that washington state is going to take this one on in court. how how has already done so. are we looking at a repeat of what's happened a few weeks ago? >> maybe. what's interesting is washington is not simply suing the way hawaii and other entities might. they are saying, hey, wait a minute. the original victory they won blocking the first travel ban should apply to the new travel ban. the argument being they're very similar. that, of course, is debated. we reported on the fact there are are several parts of the new ban that are different, the number of countries, green card holders, the refugee language. so, there are differences in its thrust it still is a ban for 90 days on a lot of countries and tightens immigration. what they're saying today is the judge, judge robart in seattle, should basically apply that same blockage to the new ban. they're saying it's incumbent on the trump administration

joining me is chief legal correspondent, my great friend and musical maven, ari melber. this is a little more complicated than the white house seems to suggest it is. clearly for the irs to distribute this tax return is absolutely illegal and someone would go to jail. >> the question is, is this criminal? you can't answer that without the who, who leaked it? we'll put up the federal law. up to five years in prison for a government employee or other certain persons who conduct an unauthorized disclosure of tax returns. obviously, if authorized by the person whose tax returns they are, if it is that person, if president trump dileak this. >> the other persons include your accounnts. >> and other individuals who may have it. we're simplifying there. the bottom line being a criminal leak of any kind does not mean that talking about the leak itself is illegal. so the white house is correct to say that if these were stolen or taken by someone in an unauthorized way, the person who leaked them would be breaking that federal law. they are incorrect to suggest that "the new york

impossible, asking a lawyer what he made of what we've just witnessed over the past several hours, ari melber. >> again, we live in a politics of culture of exaggeration but this was truly an historic and unusual hearing given what was previously public reports of russia meddling in the election. but no confirmation until today, in this hearing that we watched by the fbi director that this is being investigated for the trump campaign and russian side. the banner up on your broadcast, brian, the fbi director saying if he knew now what he knew then, he might have walked over to the dnc himself and walked on the door. that's essentially a statement of hindsight. jim comey is a steely prosecutor. he testifies with great care. by my count that was the only time today in these hours of hearings where i heard him say he might have done something differently. not because of error but because of hindsight information. the final point i'll make, this was a hearing that began with the fbi director, and of course, the intelligence director there shooting down claims made by donald trump on twitter, false

ari melber is msnbc's chief legal correspondent here with me in new york. andrea mitchell is nbc's chief affairs correspondent. hours ago president trump said he had full confidence in jeff sessions. what has happened? >> with the president, i don't know that anything has changed. we haven't heard anything from the president since those remarks made inside the aircraft carrier in southern west virginia. we understand the president is back at the white house. his aides are working their way back to the white house. we know that his administration was notified, according to the deputy press secretary. one of the press secretaries here, that jeff sessions would recuse himself from any investigation involving the trump campaign or involving russia's investigation into election meddling relating to the 2016 election. the notification to the white house came just before the press conference. so there was not an advanced notification of many hours prior to the attorney general making pib li public the fact that he would recuse himself. this is likely to take some
