melgar. i melgar i supervisor. peskin peskin i supervisor preston preston i and supervisor ronen ronen i there are ten eyes all right. the motions are approved. madam clerk, why don't we go back to roll call for introductions where i believe supervisor stephanie had just concluded? yes. and supervisor walton is up next to introduce new business. thank you, madam clerk. first of all, just want to give some. brief updates on. outside boards as far as our workforce investment board in their staff presented their fiscal year 2023 funding recommendations, focusing on on demand industries and equitable pathways for residents. the recommendations received positive feedback from wusf members and the public, and they were approved. as you know, earlier, we had an update from caltrans. but i do just want to state for the record that we shared some updates. this morning, but briefly. on july 29th, there will be an event for the public to view the electric trains for the first time at san jose dearden station and likely in early september, another event for the public at fourth and kings station in the summer of caltrain program is currently happening, which is a three month promotion for rider appreciation and promoting ridership this summer, including rolling back june's planned fare increase for another six months overall, ridership is still very far below pre-pandemic. levels, but continues to make steady increase. especially for sporting events. and as far as the bay area, air quality management district and may, the air district released its 2022 annual report, which covers the ongoing work to address disparities in air quality and the new challenges posed by climate change. the report highlights expanding partnerships and environmental justice communities and increased regulatory controls on the industry climate programs to accelerate electrification and greenhouse gas reductions. and the air district is continuing to. work on equity to ensure that. everyone can breathe clean air by addressing environmental burdens and health disparities. and historically most vulnerable communities and populations. lastly, colleagues, today i have introduction of a resolution supporting assembly constitutional amendment for also known as aquifer, which will give california voters the opportunity to decide whether to restore voting to incarcerated people completing their prison sentence. i'd like to thank my early co-sponsors supervisor ronan. president peskin. supervisors melgar preston. chan and gaudio. voting is not a privilege. it is a fundamental right of citizenship that people in prison do not lose their citizen rights, citizenship rights and disenfranchize of people in prison. disenfranchisement of people in prison, including california, dates back to the era of racially discriminatory jim crow laws and was written in our constitution. black people make up 6% of california's population , but account for approximately 30% of the state's prison population. aquifer itself is. simple. it will remove the prohibited. against people in prison voting that exists in the state constitution. if it passes, we will join states like vermont, maine, the area known as washington, dc, and puerto rico, and restoring voting rights for incarcerated people. thank you. and we understand that the right to vote is a right and everyone should be supportive of this. and i look forward to moving this forward. thank you. i submit thank you. supervisor walton, super. advisor chen.

melgar second this? mr. clerk call the roll on item 6. commissioner chan. >> aye. >> commissioner dorsey. >> aye. >> commissioner engardio. >> aye >> chair mandelman. why aye. >> melgar. >> aye. >> commissioner preston. >> aye. >> commissioner ronen. >> aye. >> commissioner safai. >> aye. >> commissioner walton. >> aye. >> we have 8 and it is approved. thank you, mr. clerk item 7ch >> item 7 adopt the prop well<,> strategic plan baseline this is action item >> this is exciting and we have and ana our deputy direct for policy and planning. and amilia wally our program analyst. >> great. thank you. so nice to hear someone call this exciting. >> very. >> [laughter]. i'm anna, nice to be here. with you all this morning and amillia will be copresenting this for you. them is the first of 2 prop l action items on your beyondch agenda today it was approve in the november and will sales tax measure on april first. now we are work on the new measure. the expenditure plan had 5 big buckets of programs within temperature such as transit project and paratransit and within the bikts are 28 programs and each those programs requires a 5 year prioritization program. in order to guide the implementation of the measure over the next 5 years. prop l plan told us the big program and how much money each has. who can apply and when is eligible and requires that the board adopt a strategic plan and 5 year prioritization program essential low a project list as a prerequisite for allocating upon funds the strategic plan is made up of 3 main elements. policy wills are ref now and expend tours. it supports delivery of the measure. it wouns have status in the strategic plan as a programmed status the funds are visible for allocation when they are red. give agencies certainty when they can count on from prop l to leverage grantsor projects red and to just get going on work. strategic complnlt 5ypp work together. they are developed the same time. the strategic plan is a 30 year period 5ypp are 5 years. the process for under taking now is to develop the 5ytp for the first 5 year and repeat every 5 years. and doing a look ahead for the next 5 years of the projects will advancing during that time. during the next update, which in 2028 we would do that. i'm not going deep in the 5ypp's my pick will be addressing those in the next item on your agenda. the strategic plan and the 5ypp they worked together so we are now in step 1. each the 28 programs by fiscal through 2053. that's the baseline for most of the categories. i will goat that. in step 2 identified projects to be funds the next 5 years and work with the community advisory committee and the public engagement and the board and project experiences to identify and identify the projects to be funded witness they are to so lidifiy we analyze financial information. how much sales tax and the levering sufficient? does everything make sense? reasonable requests? and this includes requests for from sponsors to accelerate or advance sales tax funds. has to fit within this budget for the program. we put that information in our plan financial model estimates financing costs for the programs advancing funds and prosecute have aed that information to sponsors and ultimately when everybodying jells we have a 5 year board 5ypp's the first is next mont and we will have a final plan adoption the end of the calendar year. good morning thank you for this context. the strategic plan baseline with the 3 components. first is the strategic plan policy. they provide guidance on the administration of the program. prop well<,> based on prop circumstance. and reflect the giegd principles on the slide well is a requirement which is prop l staff develop project delivery guidelines. keep anticipate bring thanksgiving to the board the end of the calendar year. the new projection in the late data take into account the actual revenue of the last 2 face cal years and [speak fast]. and the foible component is the expenditures. i will highlight a few but you can find more in your packet about them. the first is the operating cost and program administration. these are set ref now and tape are off the end of the program. we are carrying 7.9, consistent with prior years under prop k. everything left for project expenses i'm sorry. left after netting them out is project expenses and financing. >> and the lost 1.57 years of revenue actual ref nows are low and helps to ensure we have funds to cover obligations. [reading very fast]. >> and because prop l has supercede prop k we have carry forward obligations with prop k. existing debt from 2017 bonds 21 million dollars a year through fiscal 34 and 400 million dollars in remaining grant balances from about 400 open grants. during the prop well<,> plan develop the we assumed the prop circumstance carry forward 550 million dollars. it was a good estimate the existing grants revenue carried over to pay. the next shows this criminalitied to high demand for ref nows in the first few years of the prop well<,> program. a graph showing carbreimburse am for prospect circumstance. majority in the first 2 years levels [inaudible] context fiscal 23 expecting 112 million dollars in revenues. we see our fiscal 23 will be less than the approved max. we updated the moss to refect the reimbursement and match the agency budget 120 million dollars in fiscal 23. we left 24 to match the 24 budget and shifted the [inaudible] from 23 to fiscal 26. moving them out is more realistic based on importance and helps us to reduce dent costs. >> now get to prop well<,> and the baseline. 23 of the 28 programs the baseline says the share of funds available on a pay as you go bases and through the press this micheal talked about shortly sponsors request acceleration to upon support deliverability faster and a share of finance costs within the funding cap. this policy is carry forward from prop circumstance and protects the mall are on going programs [inaudible] resulting from projects to advance funds. >> for the other 5 of the 28 programs proposing to accel rit funds in the base line boy 2 big projects. thank you. >> thank you. all right. so the 5 programs in the baseline we are recommending advancing funds for our the downtown extension the portal has 300 million dollars commitment of sales tax funds dem trito the transit'd registration to have a mull mission federal grant that needs to help this sumtory meet a mile stone. and also part of the [inaudible] bart seek to advance fundses to exercise an option for rail cars. and this is to look in a lower process and working with bart exteriorings to nail down timing of the when the funds are needed. to give a picture of financing costs for those 2 programs or protects who i ensuring we meet other programs requests for advancing funds we are accelerating the baseline for 3 other large programs this we know are seeking to advance. and together these are among the largest in the prop l. with respect to maintenance this is the vehicle facility and guide ways program. the lfrjest in prop l. it has not outside impact on financing costs. we moss the accomplice holder we are working with mta to get information on the projectsless. and that we will be doing that throughout manslaughter 5ypp process. and the program 5 milling annually for san francisco contributionical trin capitol maintenance. so, the assumptions so we have a combination of front load carry forward. grant balance and 2017 bond. 5 major prop well<,> promise with proposed advance am of funds. credits a cash challenge in the first 5 to 10 years with project needs for this program exceeding revenues. this leads to the need to issue debt in the model. we included a number of assumptions to seek to minimize debt costs and fair distribution of debt with prop k and prop well<,>. as we did with prop circumstance we are on the side of conservative consumptions for debt issuance. actual devenlt, when issued if lower, which is hen in the pastment gets reflect instead next plan and you want delta goes become to projects. our prop to debt issuance enabled you to maintain a top credit rating of aaa through the pandemic this served us very well. almost to the last slide. this table provides a snapshot of the model out put. table will change when we have project programming and cash flows. proposed for the first 5 years. i will quickly walk you through. the source the ref now including a bond proceed. the loans we make on behalf of tida. like west side bridge in advance of getting repaved by funds those are loans to repay the program and keep it whole and uses side we have available projects the funds available for projects reflect the pay go and long-term principle reflects finance costs and 5 promise. everything else i talked about. this is the proposed action. buffer today to adopt baselineful and we appreciate all the partners efforts to date and look forward to working together over the summer. and the fall to develop the five year project lists. thank you. voice chair melgar? >> thank you this was very thorough and straightforward. it is amazing work. thank you. i do have a question. it is is more toward -- director chan? this. thank you. and supervisor malka . thank you. chair chan and colleagues, i really just first of all, want to thank all the early care providers and the families who have been in this process and sort of woken up to our political process. it has been an amazing thing to watch. so i want to say thank you so much. i am here to implore the committee not to pass item number 11. so i just want to tell you a little bit just personally years ago, i was offered a job by the then mayor , gavin newsom, because i had just come back into town after having been in graduate school on the east coast. and my little my girls were little. i was also offered three other jobs at the same time. and i took this job because i found childcare after school, childcare nearby, within a block of where of one south, which is where the office was. and that made the difference for me. so we know that we want people to come back to work in san francisco. the people who have come not come back in the greatest number are actually women in the number one reason, according to the center for american progress 62% is because they cannot find child care childcare. and so, you know, for me, in the cost benefit analysis of what mr. egan told us last week of, you know, the incentive that we are providing for folks who might lease up versus what we know, what has been quantified will get people here. and it's a very complicated issue. the coming back to work is not just one thing, it's many things. but this very small commercial tax decrease. it's not in the same level as what we lose by not building a system of universal childcare, which by the way, we can focus on downtown. we can focus on the areas where we want people to come back to work. but that is a personal anecdote, and i'm making a plea for you. but you know, i want to say we all share the collective goal to incent new businesses to come back to san francisco, to downtown, particularly to add back the vibrancy that we have lost downtown. and based on some of the initial economic analysis, the long term impacts and costs as a share for chance that outweigh the potential benefits , i know that this board will work closely with a mayor on the gross receipts tax and other measures, but child care and other essential types of services are also a part of the economic recovery, and they don't hit everyone the same way. this is also a gender equity issue and an issue for service workers, particularly, i look forward to thinking more boldly and courageously about all of the various elements that we need to breathe new life back into our economy. so as for item 12, the proposal to reduce the baseline of busy, i just want to say that this has been really, really difficult and i want to acknowledge the disappointment and the pain that the provider community is feeling. i also want to thank chair chan in particular for your outreach to the chinese speaking providers. these are small business women who are often left out of the conversation because they don't speak english and work really hard to take care of others. so i really want to thank you personally for your engagement and involvement in that. the uh, so i just want to say that, you know, despite the difficulty, it is difficult to accept because it goes against the spirit of the b c initiative and sets up an unfortunate precedent. the language and the initiative for bbc was deliberately written so that new revenue would supplement it existing funding, not supply it, because we're tired of dealing with that. we already know that the existing funds we have, we might not even make a dent in the growing need for childcare, particularly for infants and toddlers. and that's not acceptable. we already know that there's a desperate need for more funding to support families with young children, babies and toddlers. however, i also want to recognize that we are in a really difficult budget situation and i want to thank all of you for being here. long hours, day after days, and tackling it all. i also want to thank ben rosenfield. thank you so much for your work and for your thought partnership. and for joining for doing the same. it's been really a lot. so that being said, it is not prudent for us to balance a budget on one time. fixes but this is before us today. we have to tackle it. and so i would like to propose the amendments that you have before you to consider. and it would still result in roughly the same amount of funding available in the general fund to help balance this budget. but it does not set a precedent for reducing the bbc baseline in future years. so since bbc was held up in litigation, the revenues collected interest over time. it is a roughly the same amount of interest as what we need to balance the budget. so this amendment would tie the amount we're freeing up in the general fund to the interest accrued instead of reducing the baseline outright. this amendment would be a credit against the baseline so that we will be using the amount collected in interest to the fund. so for fiscal year 2324, the credit against the baseline for interest earned would be up to 20 million for fiscal year 2425. it would be up to 10 million. there's also language in the amendments that i submitted that states that these credits will not be applied against the base amount of any year in which the babies and families first fund is less than 100 million. the other change to the proposed legislation is that in the event the deficit in fiscal year 2324 is less than 200 million, we can only hope as adjusted at the time in march of 2024, that it would undo the freeze in the growth of the baseline as is currently proposed. so that just gives us an out if that happens . so this does not change the fact that up to 30 million of funds would that would have otherwise been used for early care in education will now be used for other budgetary priorities. i want to acknowledge that. and, you know , empathize with the pain. but i hope that we find a way to resolve this issue in the future without having to do this again . the baseline is there for a reason. again, i just want to thank our controller, ben rosenfield, and also the city attorney team, john guv'nor. scott webber. and for all their quick word, smithing and creative thinking. so thank you, chair chan, for your leadership in. i ask for your support colleagues. thank you. supervisor safai thank you. thank you, supervisor melgar, for all your hard work on this. thank you to the childcare community for your patience with me. i know we had a lot of conversations. i know you understood my anxiety. my anxiety was both for you and your long term success, as well as the success of where the source of this money would come from. and you've heard us talk today about some of the true worries that we have in the city in terms of our leasing. i do want to acknowledge that. i think that this process was unfairly thrust upon you and thrust upon us in a way that we could not have a thoughtful conversation in advance to prepare everyone truly for what the magnitude of what this would mean. and in fact, we were reacting in a very haphazard way, and we had and it caused a lot of discomfort. it caused a lot of anxiety. and i would just say i appreciate supervisor melgar intervening and working and all of the staff that she sort of woken up to our political process. it has been an amazing thing to watch. so i want to say thank you so much. i am here to implore the committee not to pass item number 11. so i just want to tell you a little bit just personally years ago, i was offered a job by the then mayor , gavin newsom, because i had just come back into town after having been in graduate school on the east coast. and my little my girls were little. i was also offered three other jobs at the same time. and i took this job because i found childcare after school, childcare nearby, within a block of where of one south, which is where the office was. and that made the difference for me. so we know that we want people to come back to work in san francisco. the people who have come not come back in the greatest number are actually women in the number one reason, according to the center for american progress 62% is because they cannot find child care childcare. and so, you know, for me, in the cost benefit analysis of what mr. egan told us last week of, you know, the incentive that we are providing for folks who might lease up versus what we know, what has been quantified will get people here. and it's a very complicated issue. the coming back to work is not just one thing, it's many things. but this very small commercial tax decrease. it's not in the same level as what we lose by not building a system of universal childcare, which by the way, we can focus on downtown. we can focus on the areas where we want people to come back to work. but that is a personal anecdote, and i'm making a plea for you. but you know, i want to say we all share the collective goal to incent new businesses to come back to san francisco, to downtown, particularly to add back the vibrancy that we have lost downtown. and based on some of the initial economic analysis, the long term impacts and costs as a share for chance that outweigh the potential benefits , i know that this board will work closely with a mayor on the gross receipts tax and other measures, but child care and other essential types of services are also a part of the economic recovery, and they don't hit everyone the same way. this is also a gender equity issue and an issue for service workers, particularly, i look forward to thinking more boldly and courageously about all of the various elements that we need to breathe new life back into our economy. so as for item 12, the proposal to reduce the baseline of busy, i just want to say that this has been really, really difficult and i want to acknowledge the disappointment and the pain that the provider community is feeling. i also want to thank chair chan in particular for your outreach to the chinese speaking providers. these are small business women who are often left out of the conversation because they don't speak english and work really hard to take care of others. so i really want to thank you personally for your engagement and involvement in that. the uh, so i just want to say that, you know, despite the difficulty, it is difficult to accept because it goes against the spirit of the b c initiative and sets up an unfortunate precedent. the language and the initiative for bbc was deliberately written so that new revenue would supplement it existing funding, not supply it, because we're tired of dealing with that. we already know that the existing funds we have, we might not even make a dent in the growing need for childcare, particularly for infants and toddlers. and that's not acceptable. we already know that there's a desperate need for more funding to support families with young children, babies and toddlers. however, i also want to recognize that we are in a really difficult budget situation and i want to thank all of you for being here. long hours, day after days, and tackling it all. i also want to thank ben rosenfield. thank you so much for your work and for your thought partnership. and for joining for doing the same. it's been really a lot. so that being said, it is not prudent for us to balance a budget on one time. fixes but this is before us today. we have to tackle it. and so i would like to propose the amendments that you have before you to consider. and it would still result in roughly the same amount of funding available in the general fund to help balance this budget. but it does not set a precedent for reducing the bbc baseline in future years. so since bbc was held up in litigation, the revenues collected interest over time. it is a roughly the same amount of interest as what we need to balance the budget. so this amendment would tie the amount we're freeing up in the general fund to the interest accrued instead of reducing the baseline outright. this amendment would be a credit against the baseline so that we will be using the amount collected in interest to the fund. so for fiscal year 2324, the credit against the baseline for interest earned would be up to 20 million for fiscal year 2425. it would be up to 10 million. there's also language in the amendments that i submitted that states that these credits will not be applied against the base amount of any year in which the babies and families first fund is less than 100 million. the other change to the proposed legislation is that in the event the deficit in fiscal year 2324 is less than 200 million, we can only hope as adjusted at the time in march of 2024, that it would undo the freeze in the growth of the baseline as is currently proposed. so that just gives us an out if that happens . so this does not change the fact that up to 30 million of funds would that would have otherwise been used for early care in education will now be used for other budgetary priorities. i want to acknowledge that. and, you know , empathize with the pain. but i hope that we find a way to resolve this issue in the future without having to do this again . the baseline is there for a reason. again, i just want to thank our controller, ben rosenfield, and also the city attorney team, john guv'nor. scott webber. and for all their quick word, smithing and creative thinking. so thank you, chair chan, for your leadership in. i ask for your support colleagues. thank you. supervisor safai thank you. thank you, supervisor melgar, for all your hard work on this. thank you to the childcare community for your patience with me. i know we had a lot of conversations. i know you understood my anxiety. my anxiety was both for you and your long term success, as well as the success of where the source of this money would come from. and you've heard us talk today about some of the true worries that we have in the city in terms of our leasing. i do want to acknowledge that. i think that this process was unfairly thrust upon you and thrust upon us in a way that we could not have a thoughtful conversation in advance to prepare everyone truly for what the magnitude of what this would mean. and in fact, we were reacting in a very haphazard way, and we had and it caused a lot of discomfort. it caused a lot of anxiety. and i would just say i appreciate supervisor melgar intervening and working and all of the staff that she mentioned and other members of the board here. but i think we ended up with probably the best solution fo

(indiscernible) san francisco land use coalition. first of all, i would like to praise supervisor melgar for requiring these units to be under rent control. while the rent control status won't make any of these new units affordable today, but it may work to the benefit of tenants decades later. having said that, we are concerned with the fate of rent controlled multi-unit buildings who demolitions are not protected by this legislation. we understand that for such units as my general public comment referred to, we are going to be relying on sb330 to figure out what the replacement units are supposed to look like. so, as most everybody knows, there are tons of single family homes in these so called well resourced neighborhoods that come with adu and udu and that will put them under the rent control status and require sb330 to kick in to help planning to address the issue of tenants displacement and whether or not the units are going to be up for sale or rent and if they are going to be up for rent, if there are tenants low income tenants living in the units then the new replacement units should be offered at the same income level. so, the problem with relying on sb330 is this, we two problems. for one, sb330 i guess most people probably don't know because we don't think too much about the future, sb330 is supposed to be sunseted in 2030, and in the absence of demolition control for rent controlled multi-family dwelling units the demolition of such units will be legalized when sb330 is sunseted in 7 years from now. we are sure this is not the outcome supervisor melgar intended and that's why we strongly urge the supervisor to amend the legislation to provide demolition protection for rent controlled multi-family units. also, sb330 has the provisions for right of return and setting the rent for the replacement units. my question is, who is supposed to notify tenants when the replacement unit is ready to move back in, and who is supposed to enforce which agency in the city is supposed to enforce this? i know the planning has issued directive in terms of the time of filing the application, the developers also provide this information, but that is not clear to me, so please do elaborate on that. thank you very much. >> seeing no additional members of the public coming forward in the chambers, let's go to the remote callers. >> good afternoon. my name is george wooding. i wanted to say first eugene (indiscernible) i think moore hit the nail on the head when she asked the question why go to 6 instead of 5? if you are around (indiscernible) you realize if
