joining me is melissa murray, law professor at new york university, and msnbc legal analyst. ssa, how on earth could a case even make it to the supreme court that says that the government can't charge people who did insurrection with interfering with the processes of congress? >> well, joy, the case is called fisher v. united states. and this january 6th rioter was charged under the statute that was passed in the wake of the enron scandal, so one of the arguments that was made was that the statute was never intended to apply to a situation where someone was obstructing a congressional proceeding but rather was meant to deal with circumstances where individuals were doing things like evidence tampering in furtherance of the obstruction of official proceeding. so these don't necessarily match up. mr. fisher is already arguing he was never in the capitol for a long time and for that reason had no intent to actually obstruct the congressional proceeding. it's really a question of statutory interpretation and whether the scope and substance of this statutory provision was meant to

i want to bring in msnbc legal analyst, melissa murray who was a former law clerk to then judge sonia sotomayor. melissa, as we learn this news that retired justice sandra day o'connor has passed away, what's going through your mind? >> well, obviously, justice o'connor was a trailblazer in many ways. she was the first woman appointed to the supreme court, this was back in the 1980s. she was ronald reagan's first appointment, and she really was the center, the fulcrum around which the court moved for many years during her tenure. she was, as lawrence has said, conservative. she came from the west, arizona, where she had been a state legislator and then later a state judge, but she was meant to sort of keep the court on a conservative path, nominated by a republican justice. she was very interested in questions of state prerogatives, maing sure that the states maintained a role in a fed rated system without the federal government overtaking some of the traditional functions of state government, and so she was very much associated with that move toward a, quote, unquote new federalism.

melissa murray a professor at the new york university school of law. hairy litman a deputy -- and they join me now. it's great to have all three of you. my first thought was how should i feel about this. first i texted kate. but i'll start with you, melissa. how should i feel? how do you feel? >> i'm a little surprised. as you say it's not uncommon for the roberts court to grant cert before judgment. they did so last year. the fourth circuit was waiting to decide the unc case but took it up on cert anyway. the united states vs. nixon the supreme court granted cert before judgment in order to determine if richard knicks had to comply with the request to turn over certain tapes because there was a pending criminal trial of the watergate burglars. it's not just simply a criminal trial going on here but the fact of an election and whether or not the american people deserve to know whether someone they're voting for is able to stand trial on criminal charges. so it seems like there are really important issues at stake here, but the court kind of slow walked
