trump has been criticizing judge merchan and even his family for months now, and judge merchan has properlytored that out of his decision making best i can tell. in both of those ways, i think judge merchan is playing it down the middle as a good judge would. i don't believe he would hold it against mr. trump if mr. trump is not contrite or apoll gettic or remorseful at sentencing and even if the attacks continue on judge merchan, he has demonstrated the ability to brush that aside and do his job in the proper way, chris. >> that brings me to the one thing that judge merchan did deny donald trump's team. he said, i'm not going to preclude the people from filing a presentencing memorandum. we should remind people that there are 34 felonies that donald trump was convicted of. each carries a possible sentence of four years behind bars unlikely i think that they, obviously, would be served consecutively if there was to be any jail time, it would most likely be concurrent. but what would a sentencing memo like that contain, do you think, and what do you expect the prosecution to arguing for? >>

let me read quickly from the decision by judge merchan. he said he's made this decision on the position of sentence being adjourned to avoid any appearance, however unwarranted, that the proceeding has been affected by or seeks to affect the approaching presidential election in which the defendant is a candidate. so he made the decision that, pushed back several times as it has been, that sentencing the former president now, if there were any delay, that would get us within 41 days of reelection if he was even delayed by another week. he says, i'm just not going to do it because it would seem to be something that would weigh in on the breadth and depth of the presidential election. and he is just going to wait until afterwards. >> to me that linkage is so interesting. kerri and i sat through weeks and weeks of this trial in new york, and merchan often made decisions that were not popular publicly or didn't comport with timelines the defendant wanted. so for him to now say, okay, i want to have any appearance of us doing anything wrong, he

judge merchan does not want to advantage or disadvantage any political party or candidate, and thus is moving the sentencing date of donald trump. so there's the possibility now that trump either could be a criminal defendant with no special powers whatsoever at his disposal come november if he loses the election or he could be the president elect of the united states, a man with pardon power over federal protections, a federal convictions, but not somebody who would have any part pardon power in a state case like this, this hush money criminal conviction so a lot is going to be happening over the next couple of weeks. there. we also are very aware that his team is going to continue to fight, not just the fact that he's going to be sentenced here in this case in november, but all of the cases and to that point, on friday, his team was in court on friday in an appeals court, trump attended a hearing to last about a half an hour before three judges, where they're trying to overturn a $5 $5,000,000 defamation verdict that a jury awarded to the columnist e jean carroll for sexual abuse and

what do you think that merchan is going to decide on that? >> well, i think if you made me bet, i think he's going to come out and say that there was error, which there clearly was, in light of the supreme court's opinion, but that it was harmless because it was outweighed by a mountain of evidence against president trump. that's what he will say, i think. this is a problem entirely of alvin bragg's own making because he did not have to put former presidential advisors on the stand to talk about their conversations with president trump while he was president. that was totally unnecessary for him to wane his case, but he put them on and here is the problem from his perspective. his prosecutors made a big deal about it in their closing statements. obviously bragg himself was not trying the case, but they made the decision to make a big deal about that testimony in their closing arguments so i think it's a real issue. it's not a frivolous issue at all for trump and his attorneys to raise. david: and by the way, for those who have forgotten, the

didn't really help judge merchan because the d.a.could understand why you might want to put it off and to be fair there is some legal issue about whether you're allowed to appeal that immunity issue before sentencing. so there is -- because we're in such a new world, because the supreme court issued that crazy decision. so that is where he was. and so, um, he agreed to put the sentencing off and the immunity decision. so all of that, those two things are now put off until november. i'm not so sure that ultimately even though i know donald trump asked for it, i'm not so sure that is really going to work to his advantage. because one of the things that it does, by judge merchan putting both of those things off, the supreme court cannot get its hands on this case before the election. and i'm such a detactor of what they did in that immunity case, it is so hard not to view it as political. in a capital "p" sense, this makes it impossible for them to do and it means that judge merchan will be able to reach this decision with the election
