despite his office developing a case against epstein acosta traveled from miami to west palm beach meeting privately with epstein's lawyers. for some reason out of that meeting came an npa, a nonprosecution agreement that basically allowed a guilty plea on lesser state charges. epstein was to serve 13 months in jail and required him to register as a sex offender at acosta's confirmation hearing to be secretary of labor senator tim kaine of virginia pressed him on this nonprosecution agreement. >> there is an allegation that i just read that you did not pursue a federal indictment even though your staff had advocated that you do so, is that accurate? >> that is not accurate. >> federal prosecutors detailed their findings in an 82-page prosecution memo and a 53-page indictment, but epstein was never indicted. then there is a quote, quote, this agreement, the agreement you describe, will not be made part of any public record. >> it is pretty typical in a prosecution for an indictment, a draft indictment, to be written. that doesn't necessarily mean that that draft indictment is filed because

shutting out his victims and the media, including suggesting that the charges be filed in miami instead of palm beach where epstein's victims lived. we've reached out to the palm beach county prosecutor's office to hear what they've got to say about what acosta said about them. we've got no comment on that from them, but we have our team covering all angles of the story. joining me now from the department of labor, peter alexander who was at that press conference that we just finished listening to, and he asked a question or two there. and nbc's investigations correspondent tim winter who has been focusing on this very closely over the last few days. peter, let's start with you. what was your big takeaway from this news conference? >> reporter: well, there were a series of headlines that i think we're going to leave this news conference with. he was asked on multiple occasions whether he would apologize to the victims. he did not do that. he was asked again and again, said the best he could do to sort of understand their plight was to think about his own young daughters in a situation like this. but

today the "miami herald" is reporting that the palm beach county sheriff's office opened an internalffairs investigation into whether they properly handled epstein's case. this deal that allowed a sexual predator to go to work every day and still somehow get access to children, i assume that's unusual. >> this is really a shocking deal that epstein had. it's unprecedented to be in prison on these kinds of changes and to be in jail and have this ability to go out and access more minors? someone was asleep at the switch and i'm not particularly impressed by the early reports that indicate that the sheriff who is in place during epstein's very generous conditions of release that he will be conducting this investigation into his own conduct. >> let me read a little bit of epstein's accuser's lawyers. how he had women over to the office in his work release. he's in prison out on work release. he was in the office most of the day and what i can tell you is he had visitors, female visitors. i don't know that any of them were underage and the visitors were there not for business. it was sexu
