there is, of course, something that parallels the situation with michael cohen, and they are really tryingd having anyone else who could be really helpful to prosecutors, right, go out and turn on the former president. so we'll see if giuliani gets any more help with those staggering legal bills. >> to that point, what's your response to kind of this dynamic now? >> look, the two biggest reasons that people cooperate in general is, one, they're facing print time which rudy giuliani now -- prison time which rudy giuliani now is, and two, finances. that said, i'm not cooperating with rudy giuliani in a million years if i'm a prosecutor. and i've cooperated with people who have done way worse things than giuliani has. murderers, i'd put them on the stand. the problem with rudy, he's not done anything nearly as bad but his credibility is zero. he has the least credibility of any human being i can think of. i don't see him as a viable cooperate for prosecutors. maybe i'm wrong. you have the defense view. >> i'm with you. >> that is exactly what we need on television. all right. thank you very m

that's kind of an odd case involving michael cohen and others. and then you have the mar a lago case. and in my mind, that is by far the strongest case. and in particular because of the obstruction of justice, when he's telling people to erase video, that's pretty key evidence of his intent. so how do you expect trump's legal team to respond to what we expect is going to be an indictment in the state of georgia? and how do you think the response will differ from from what we have seen previously with these other charges? well, we'll see the kind of attack that we've seen donald trump bringing all along, saying that this is a political witch hunt in that, in fact, people have misconstrued what he has to say. i think on the more serious side, he's going to say that my statement i didn't really know that i had lost the election. so i wasn't asking people to do something i knew was untrue. that's becoming much harder for him to say. the more people who come forward and say, i told them he had lost the election and he still wanted to push. yeah, we ju

with us now former federal prosecutor dania perry, representing michael cohen in a civil case againstp and mark zaid is representing the state of brian sicknick in a civil lawsuit against trump. dania, to the argument being made by mr. loro there, trump's counsel, frespeech. say what he said and in the to indictment he said he had a right like every american even to declare falsely the outcome of the determination of fraud and he had one. >> what's the prosecutor's way around that? >> i think that's a strong man argument. if he had been charged with inciting an insurrection, for example, there might be a first amendment defense. the charges were crafted very carefully here and skirted that issue. so the question really is not whether or not the former president believed that the election was stolen and we'll put a pin on that because it is very clear from the four corners of the indictment that he didn't believe that, but was anything done in furtherance of the scheme to overturn the results of the election? and here there are so many allegations about, for example, the false slate of
