he's going to be such an interesting, there's gonna be a moment when michael cohen takes a stand in a criminal trial against donald trump. i'm interested what you think of his credibility. i mean, michael likes the client. i know michael. i consider him a friend but we know his history. michael likes to claim that the only things you ever lied about had to do with donald trump, that's not really true though. he was convicted of personal tax fraud, he now claims he lied when he pled guilty to personal tax road. i see him as a problematic witness. >> well, he's more than a problematic witness. he could be exploding hand grenade for the da's office. there's a lot to work with if you're cross if you're cross-examining michael cohen, a lot, and there are conflicting stories about the same story. and so but i think as former prosecutors, we also understand that it's your job when you have a very difficult witness to make sure that the jury understands who he is. they have it's been preset. they know this is going to be a guy with a bad past you've got to inoculate the jury, and then i think

michael cohen is a liar. i mean, the documents are the documents and it's a tough case to defend, but there's the idea of the underlying crime here. i mean, he keeps saying all legal scholars look at this and say they don't even know where the crime here is, that there's the question of the case of what actually is the it's not the hush money per say that there's an underlying it's how those docx as how those payments were handled in the underlying paperwork. and he made the exact argument that you're implying that there's no crime here to the judge and an opinion issued today, the judge said, yes, it is a crime if the prosecution can prove it, alvin bragg has actually brought up like three or four different options for what the crime it so it's primarily a legal argument that he made to the judge and lost today. but how this is not a crime, you can't essentially incorporate one of these theories into the crime of falsifying find business records and he lost on that. now he may prevail on that on appeal sunda

and then trump reimburses michael cohen that $130,000.t that point that the manhattan district attorney, alvin bragg, argues that donald trump had committed fraud, because he's arguing that he falsified business records to cover up that payment for why he gave that payment in the first place, why he was reimbursing michael cohen, and why michael cohen was paying stormy daniels in the first place. so, he's charged trump, alvin bragg has charged him with 34 counts of falsifying records. and he's basically arguing that trump was trying to hide this fact from voters, and thus was -- this is an election-related crime. he says that he falsified these records and that that's what's going to be in this case that will be starting soon. the legal analysts i have spoken to note that these are relatively low-level felony charges that the former president is facing. and so even if he were convicted of all of them, most of them believe it is very unlikely that the former president would be facing any prison time. amna: so, william, this case in new yor

michael cohen is going to be a key witness. what are your thoughts about those findings about michael cohen's credibility? do you think it will pay play a factor into the trial next month? >> yeah, no case is a pellet proof. we all know that virtually every significant loss, whether in the civil setting or criminal trial, it ends up getting appealed. but when you work your way through judge engoron's findings and fact -- conclusions of law, it feels like donald trump can impaled this judgment. but i would be surprised if he won any relief on appeal. and listen, michael cohen's testimony was relied upon in this trial. i would call that important foreshadowing for what is to come. soon to come, beginning march 25th, the first criminal prosecution of donald trump for his attempt to interfere in the 2016 presidential election by making hush money payments. and then, by falsifying business records to cover up the nature of the hush money payments. michael cohen will be a star witness and importantly he will be bolstered considerably
