michael doyle, the supreme court correspondent. were there indications during oral argument of the direction the chief justice would be going? >> not to me. the decision to base the upholding of the individual mandate on the taxing provision was not heavily discussed at oral argument. two hours of argument on the mandate essentially and most of the focus was on the commerce clause and its lack of power. >> have you had time to spend time with the decisions? >> i have. it's about an inch thick. i looked through it as best i can in speed reading mode. >> what stands out to you? >> well, one was the way that chief justice roberts thread the needle here. he upheld the law in the most conservative way possible. the four liberal justices would have upheld individual mandate under the commerce clause which is expansive and justice roberts says that's going too far. you can't compel activity. however, he was able to find the power of congress to lay taxes and use that as justification to uphold the law. it kept the fairly conservative in t

supreme court reporter michael doyle is with mcclatchey newspaper and has been covering this from thethanks for being with us. >> my pleasure. >> how surprised were you that the deciding vote came from chief justice john roberts? most people expected justice kennedy would be the swing vote, but while he came down with the dissenting vote we saw roberts upholding the law? how surprised were you? >> i was surprised by the outcome. i personally thought the law, the individual mandate, would be struck down, but i always thought that justice roberts would be in the majority as chief justice on the highest profile case of his career on the court. there's just no way he would have allowed himself to be in the minority. so i was -- i did not expect the conclusion, but i did expect him to be in the winning side, whichever way it turned out. >> in your opinion what does it say about the chief's justice and what does it say about his legacy? >> he's an incredibly adroit man. he gave the president an obvious victory in upholding ated forrable care act, but i -- the affordable care auto, but he la
