official panel of michael jackson experts joins me now to talk about this. on family attorney and diane dimond is a reporter and author of "be careful who you love, inside the michael jackson case." diana, i want to begin with you, does the multimillion dollar case come down to who hired murray? how do you prove that? >> the case had a lot of other components to it in the beginning, but it has been reduced to that. who actually hired, who was going to pay conrad murray and i should tell you right off the top there were no contracts ever signed and conrad murray for all the time he worked for michael jackson expecting $150,000 a month salary never got paid a penny, so how do you prove with no contract signed who hired him, who paid him, whose responsibility he was? he was actually michael jackson's friend, doctor friend, who he had met many years prior because he'd taken care of his children and it was michael jackson who brought him into this sphere, but where's the responsibility? that's up to the court. >> so, debra, knowing that there were no contracts sig

and it was michael jackson who brought him into the sphere. but where's the responsibility? nowing there were no contracts signed, what chance do the jacksons have in winning this case? >> the remaining cause of action, which was negligent hiring by aeg, would fall down to the evidence. it would be in the form of testimony and e-mails. if there's no signed contract, was there an unsigned contract? from what i understand, conrad murray will not be testifying, so you won't hear from him. naturally, you're not going to hear from michael jackson. i would look to any e-mails or intercommunications between aeg and conrad murray, if they, in fact, exist. and my understanding is, there may, in fact, be an e-mail from a ceo or an executive at aeg, which discusses who murray works for. so these are evidence pieces that are going to be absolutely important for the trier of fact. >> and actually, debora, the family does say they have an e-mail that's proving that aeg live was paying dr. murray's salary. here's what the aeg co-ceo said about him days before his death. "we want to remind m

michael jackson died before it was signed. that's why it's so very complicated.g gun e-mail where an executive at aeg allegedly says something to the fact that we're his boss, but we will see. let's see what happens in the trial having covered many cases involving michael jackson, and it's never ever simple. >> we have seen a lot more of jackson's children since his death and we know that prince, blanket, paris, along with his mother, katherine jackson expected to testify. what other than the obvious emotion do they add to this? what do we expect to hear from them? >> the key is the irresponsible way that dr. conrad murray behaved once he found out something was terribly amiss with michael jackson, instead of immediately calling 911 and calling for pair immediat param calls prince and he can layout the horror of that day. these kids, some people don't give them as much compassion as they should because they are rich and famous, but they went through a horrible traumatizing experience and somebody should pay for that. >> you have a lot on your plate with jodi aria

then at jackson's request he administers parole follow killing michael jackson and now the jackson family'ster. they got to convince the jury of that and they got $40 billion. i say it is an uphill battle to sell that theory. >> so rachel, are you saying this is laughable? >> yeah. i agree with paul. what we're dealing with here, it doesn't make somebody professional incompetent to have personal debt. there's only one remaining claim here. aeg has actually taken this one remaining claim up to the appeals court. the negligent hiring claim is the only claim remaining. they're saying, look, we can't see that it's reasonably foreseeable that this doctor was going to even be a bad doctor, let alone commit criminal manslaughter -- criminal manslaughter in this case which is what happened. so i think that it is going to be a pretty strong case for aeg but what aeg is saying to the appeals court is look, we shouldn't have to go through the expense of having a jury trial here in this silliness that is this case. katherine jackson putting these kids through this, this is everything that mr. jackson d
