michael lee, planning department staff. the item before you is the appeal of preliminary mitigated negative declaration for the proposed project at 65 ocean avenue. last week we transmitted a packet containing a draft motion and appeal response. appeal letter and amended m and d. i submitted minor amendments to exhibit a of the draft motion. in appeal response 3 on page 5 there is a table. we corrected one of the numbers and added a note to the table. we can address that in more detail if you have specific questions later in the hearing. the decision before you today is whether to adopt a motion to affirm the m and d if you find it could not have a significant effect on the environment. if affirm it may take action on entitlements. you can also send it back to planning for specific revisions or over rule and require the planning department to prepare an environmental impact report if you find there is substantial evidence to support a fair argument the project may have a significant effect on the environment. if the commiss
