attorney and msnbc analyst, and michael steele, former rnc chair and msnbc political analyst. jack smith has been talking to richard donoghue. when i heard that news, my spidey sense started to tingle more than usual. he's already spoken with the jan 6th committee. what does that tell you about the depth and breadth of jack smith's investigation? >> he's at the center as a witness, not a defendant himself of donald trump's efforts to use the justice department as a weapon in this case. you may recall there was that letter jeffrey clark drafted and proposed they send under the name of the acting attorney general rosen, that georgia and the other state were in play, suggesting they resubmit and get new state of electors. rosen also testified he attended a 90-minute interview with donald trump where they went through one by one all the crazy schemes -- suitcases full of ballots and dead people voting, and debunked all of those things. and that meeting was in december of 2020. and then we find trump in january of 2023, still pushing the stolen election agenda. and so that says to

i am michael steele in for my friend ayman mohyeldin. let's get started. ♪ ♪ ♪ tonight, we begin with a major legal setback for donald trump. after seeking to delay his classified documents trial until after the 2024 election, the twice indicted ex president has been met with major pushback from special counsel jack smith. trump's legal team had argued that, under smith's proposed timeline for the trial, which the cult unreasonable, a fair trial would not be possible and considerations should be paid to the fact that much of the presidents schedule will be consumed with campaigning. in effect, trump wanted to postpone the trial indefinitely and was using his presidential run as an excuse. but in a court filing this, week assistant special counsel david harbuck did not mince words saying, quote, many indicted defendants are demanding jobs that require a considerable amount of their time and energy, or a significant amount of travel. the speedy trial act contemplates no such factor as a basis for a continuance and the court should not indu

i'm michael steele in for joy reid, and we begin tonight with what has become abundantly clear.ald trump has met his match with special counsel jack smith. unlike trump who always relies on insults, conspiracy theories, and alternative facts, smith is putting in the hours and doing the hard work to uncover actual facts and evidence. and last night, that due diligence was on display when the special counsel's office issued a superseding indictment in the classified documents case. it added three new charges against trump, one count of willful retention of national defense information, and two additional counts of obstruction. it also named a new defendant, carlos deoliveira, a property manager at mar-a-lago. de oliveira allegedly helped trump's longtime valet and codefendant, walt nauta, move boxes containing classified documents out of a storage room. he allegedly spoke with "trump employee 4" which we now know to be yusuf taveras, the director of security, for trying to delete the security footage showing the boxes moved. we'll get back to that. i want to focus on something els
