michael sheerer is white house correspondent for "time" magazine which this week features a 36. page in-depth health care investigation and getting to that report in a minute but starting with the sequester. there's interesting new polling of who the american people are likely to blame. 49% say congressional republicans. 31% say the president. also, other polling showing a majority of even republican voters actually support the president's approach with a combination of spending cuts and tax hikes. what do you think's the best approach for the republicans at this point? >> i think what they're going to do is let the sequester happen to declare a victory and then have to come to the negotiating table. right now, republicans are not in the good position. it's worse i think for them looking at this polling than it was in 2011. even maybe than it was right after the election. they don't -- you know, i talked to a democratic hill aide today saying you have a 55% president favorability going up against a 10% congress. it's a fight they want to have. democrats are eager to have this fi

and there is a lot of concern even from the white paper that michael unveiled. that's why this has become so controversial. this is a hearing where the last thing they wanted was this much controversy and argument over these issues on the eve of the confirmation hearing for john brennan. >> do they think that they are essentially ensuring that the confirmation hearings aren't going to be all about this? because at least the senators will have confidential access to classified information that the public doesn't have, and so that will be discussed in closed session. the public session there can be about more public matters, something other than this? are they trying to clear this off the decks for the public hearing? >> absolutely. they're trying to take this out and take some of the sting of the hearing. there are going to be some other issues. he answered questions they has posed, and today revealed he has twice been a witness, a witness, not a target, of investigations into leaks. one into a bombing plot in yemen, and another the leak of information about the

so, michael, this is being called a white paper memo. explain to all of us what is that. and attorney general eric holder said last march that it was constitutional to kill americans abroad if they were posing a threat of violent attacks. so explain how all of this meshes together. >> sure, exactly. well, first of all, the strike against anwar awlaki, both were killed in 2011. got a lot of attention because they were both american citizens, had never been charged with crimes, and raising the question, what is the u.s. government's authority to kill an american citizen, who has full constitutional protections, the same ones you and i do? and the justice -- it has been reported that the justice department's office of legal counsel, its official arbitrator of legal advice for the executive branch wrote a memo that laid out the legal justifications for targeted killings of americans who were believed to be al qaeda leaders. but that has never been made public. and there's been a lot of clamor from both the news media and members of congress to see what are the legal justifica

michael, a lot happened certainly since you broke that news of what was in this memo including this move by the white house. what do we make of at least what we're seeing right before bren anna nicole's confirmation hearing in regards to the white house's latest move here? >> well, first of all, it was an important step that the white house took because until last night, the official position of the administration is they couldn't even confirm or deny the existence of such a memo. in fact, they said that it's in and of itself was a classified matter so by putting out the statement last night that they were going to let the house and senate intelligence members review the memo, they were declassifying the fact that the memo exists. now that said, while that's been applauded as an important step forward by wyden and others, there're chafing my members of congress about the restrictions put on the access to this memo. it's only house and senate intelligence committee members. they can go in to a classified skiff, classified room and review it. they cannot bring their staff. and they kabt talk about it a
