nbc's michelle franzen join us live from outside the harrisburg courthouse in pennsylvania. michelle? >> reporter: garvin, that testimony today was graphic in detail and also revealing about what mcqueary says he quit witnessed in 2002, what he told penn state officials, and how they reacted. for the first time, mike mcqueary spoke publicly about allegations he witnessed jerry sandusky having sex with a boy in a penn state locker room shower in 2002. in graphic detail and under oath, mcqueary, then a graduate assistant, says he first heard noises coming from the shower, then saw sandusky standing behind a boy with his hands around his waist. he testified that while he wasn't 100% certain, he believed sandusky was molesting the boy. his testimony is key in the hearing for two penn state university officials facing perjury charges. prosecutors say tim curley and gary schultz lied to the grand jury about what mcqueary told them. >> most 6 or 7-year-olds understand what it is to tell the truth or lie. >> reporter: legal experts say mcqueary's testimony today was convincing and da

michelle franzen is live in state college, pennsylvania. michelle, right now we're hearing sandusky has waived his preliminary hearing so he's not going to face the accusers after all. >> reporter: that's exactly right. this a surprise move as the hearing was set to get under way, a judge said all rise. and jerry sandusky ask he waive his right to a preliminary hearing. up until this point the defense attorney said they would go through with the hearing giving them an opportunity to see what they had and to cross examine his alleged accusers. ten were named in a grand jury report that was issued a month ago. about eight of them along with other witnesses were said to u -- were going to testify today. that will not happen now. instead, jerry sandusky has left the courthouse. he'll have his arraignment for january 7th. several press conferences are under way. the prosecution spoke a short time ago saying they plan to move forward with the case. of course, with the arraignment. but waiving the rights to the preliminary hearing certainly spares

nbc's michelle franzen is live outside the courthouse in harrisburg, pennsylvania. ch. i know this has been dramatic, troubling, emotional testimony today. what can you tell us from what mike mcquery said and his demeanor? >> it was the first time mike mcweary spoken publicly after giving his grand jury testimony several months ago. as you mentioned, it was graphic and detail and still under oath. mcquery says that he saw and heard noises coming from that locker room on campus. the penn state campus in 2002. he said he witnessed after hearing noises in the shower room, he said that he saw jerry sandusky with a boy in the shower and said that he believes that jerry sandusky was molesting the boy at the time. he said he was shocked at what he saw. he left locker room immediately and called his father and sought advice if his father. his father said that he told him to contact joe paterno, of course, the head coach for penn state's football team. and he said that he had a meeting with joe paterno and then about ten days later he had a meeting with penn state officials.

michelle franzen joins me from harrisburg, pennsylvania. we know in the past, he sent a note to his friends in an e-mail saying he tried to stop this alleged assault in court. he explained the way he tried to stop it was by slamming a locker. >> yeah, well he said that he made contact and tried to make eye contact with them about three different times. he told prosecutors that he was certain that both san dusky and the boy he said was in the shower room at the time saw him and separated at that time. he said he was so distraught he was in shock. he walked out of the locker room and immediately turned to his father for advice going to his home and his father told him he needed to get in touch that head football coach joe paterno and they told prosecutors that he did relay to paterno as well as tim curley as well as gary schultz the severity of what he saw that day. they are here today saying that he did not go into that detail about the seriousness of what he saw in 2 thousand 2. the court session will focus on written testimony from curley

nbc's michelle franzen is covering the story for us. good day to you.ect. >> new york police released that photo that you just showed from a video that captured that attack on camera as it played out. they were hoping to catch the suspect, but evidently overnight someone walked into the police station and identified themselves as the man who was responsible for dousing a woman inside the elevator with some sort of accelerant and then setting her ablaze in that elevator. they're questioning that man at this hour. they're not -- they have not filed any charges but police say that they are questioning him in regards to that attack. this woman was in her 60s and she was inside the elevator of her apartment building carrying a sack of groceries. when her elevator doors opened up, the man was waiting for her according to police and started dousing her with some type of accelerant. and then set her ablaze with some molotov style cocktail. closing the doors captured all on camera. very brutal, brutal attack. >> it really is so incredibly sickening. it has all o

nbc's michelle franzen is live outside the court nous harrisburg, pennsylvania. stant coach mike mcqueary has been on the stand. i have been reading some of the testimony. it's, frankly, hard to even read. >>> it is. it is graphic testimony. and it details what mike mcqueary says he saw and heard back in 2002 in that locker room. the penn state locker room shower room. what he has been telling the court the last hour is what he had told the grand jury in that report that was released in early november. he told prosecutors today that he heard noises coming from that shower room and looked in a mirror and saw jerry sandusky with a boy in that shower back in 2002. and he says he believed that -- he believes that he saw jerry sandusky molesting that boy. of course, there is other testimony about mike mcqueary, the then-graduate assistant, now assistant football coach, family friend, who said that he had spoken to the grand jury, said that he had testified and told him on the night of the alleged abuse, mcqueary said that he had only heard noises. so, that coming out.
