jose because of the coyote creek flooding. good morning, it's thursday, july 6. i'm michellem anne makovec in for kenny choi. >>> first, let's start with traffic and weather this thursday morning. jaclyn, you have some action down in san jose? >> yeah. we have a fire and we have an accident causing delays. first the crash, northbound 101 right near oakland road or 13th street. you can see that backup is stretching beyond 280 at this point along 101. speeds drop below 25 miles per hour. give yourself some extra time heading in that direction. also a fire past that -- let me show you 101 at first street. you're moving again. so you just got to get through that stretch just past the 880 interchange there. southbound 87 at alma road, fire and smoke that can be seen from vehicles trying to head along 87 and that's slowing your ride down in the northbound direction. we have speeds just below 45 miles per hour, and reports of a new accident along 880 and "a" street. they are making their way into hayward. here's a live look in oakland. traffic looks ok

jose, victims of february's coyote creek flooding plan to file a lawsuit. good morning, it is thursday, july 6. i'm anne makovec in for kenny choi. >> i'm michelle griego. s 6:30. >>> kpix 5's jackie ward is live in san jose with the details of the push to cover damages from the coyote creek flooding. >> reporter: here we are nearly five months after that catastrophic flooding hit the coyote creek area and as you can tell, clean-up far from over here. there are piles of garbage all over the place here in the neighborhood. the community still trying to rebuild nearly five months after it was flooded and residents had to be evacuated. and this morning some of those people are putting the blame on the city of san jose, the santa clara valley water district, and the county of santa clara. the rocksprings park neighborhood was under four feet of polluted water at one point and there are still about 100 people displaced from their homes. a plan to protect this area from flooding in the future is in the works and consists of extending floodwalls and levees a few miles upstream of coyote creek. but residents we have spoken to in the past are skeptical, understan

michelle griego. there's been a lot of finger- pointing over who is responsible for the coyote creek flooding and damage. today families in san jose spoke about the devastation and many are upset with how officials handled the evacuation. >> we're on the first floor, so we did lose everything. we had no warning and it was a little disconcerting to find out that the animals had been in the park rescued and moved and we weren't given, you know, the decency of a warning. >> kpix 5's jackie ward explains, residents are now taking action and filing claims. >> reporter: it's been nearly five months since this neighborhood was under four feet of polluted water, and as you can see, this neighborhood is still covered in filth. people are living among it. they are putting the blame on the city of san jose, the santa clara valley water district and the county of santa clara. at one point, san jose says 14,000 of its residents had to be evacuated and find temporary housing. the san jose mayor admitted the city failed to provide adequate warning to people about the likelihood of the flood and that more should have been done. amanda haas is the

jose a handful of victims are suing the city and county. those victims are telling us today they didn't have enough warning and don't want it to happen again. michelle roberts is in the rock springs neighborhood. what do they want from the city and county specifically and has that neighborhood recovered. >> reporter: i would say half the neighbors have moved in, but still a lot of work to be done. painters and people making repairs. you can see the trash on the ground and many buildings have the orange x mark indicating the building is clear. juanita wilson said she lost all of her belongs. firefighters knocked on her front door from a rescue boat. >> a lot of anxiety. >> reporter: she and six of her neighbors filed a claim against the city of san jose and santa clara county, and santa clara county water district for failing to give more notice. the water district has accused the city of failing to heed the warnings and evacuate cities in time. >> i want everybody who has gotten back into their home to know this isn't going to happen again because it was traumatic. >> reporter: the homeowners are seeking damages. and emotional suffering they endured

michelle griego. sandra osborne is live where a fire got a little too close to home. >> reporter: we're talking about a mile and a half away from a whole neighborhood in the east foothills of san jose take a look behind me, you can see where the whole thing started yesterday morning at 4 a.m. notice the charred bit next to the asphalt. that's where a car pulled off to the side of the road. the fire spread to the very dry vegetation right off the side of the road. the grass just igniting. neighbors noticed the flames on sierra road, about a mile and a half east of the neighborhood below. that fire started at the vehicle and spread to the nearby grass and burned about 3 acres. the situation was not unusual and the fire is not suspicious. but some neighbors are convinced there could be foul play. >> if you guys have a heart to stop what you guys are doing, please do so. your guys are destroying home and property. and messing with our lives here. >> reporter: and that property caretaker was out mending a fence where the fire happened yesterday. fire crews have tips for staying safe and aware. ready, set, go. be ready by making sure there's at least 100 feet of defensible space around y

crews in san jose are keeping an eye on hot spots after a massive fire rips through the east foothills. good morning, it is wednesday, july 12. i'm kenny choi. >> i'm anne makovec in for michelleo. it is 6:31. >>> jessica flores has a look at the damage left behind at the scene. jessica. >> reporter: anne, kenny, we just got an up data right now from fire crews. they tell us that this fire is 50% contained. you can see behind me, i am standing in front of the home that was burned in this fire. this one completely destroyed. another home burned. if you look up above, we have chopper 5 in the air that gives you a nice view of the entire fire. it wrapped around the community burning hills on both sides of the street. right now the huge flames are out, but fire crews stayed through the night monitoring hot spots working to make sure the flames don't spread. it's smoldering right now. the fire started at 4:30 p.m. yesterday and fire crews raced to contain the flames that burned more than 100 acres and filled the sky with thick smoke seen for miles. one home destroyed, another burned. the flames forced evacuations for 11 homes. we spoke to one of the residents who described the chao
