joining me now is cnn's miguel marquez. miguel, a 12-year-old boy calmly takes a shotgun to school and opens fire on classmates in the gym. do we have any idea yet about motive? >> reporter: we don't. clearly this was a student at the school. this is somebody who could have had a bullying incident with one of the boys, the boy that was shot. it could have been a loathing for someone so young. but the idea that this would have to be settled with a shotgun, it's sickening. >> we also in terms of his age it's very hard to remember a boy or a girl for that matter this young. i know there have been very young shooters in the past in america. but for 12 years old, it really does take this gun epidemic to a whole new level, doesn't it? >> reporter: it doesn't even seem possible. this is a middle school. back in '98 there was an incident where a 11-year-old shot and killed along with an accomplice shot and killed five people and injured ten others in jonesboro, arkansas. but not for a long time have we seen somebody so young plan th

miguel marquez joins us now. what do we know about this, miguel? >> reporter: we know that the two victims, the girl, the 13-year-old girl who has been taken to lubbock trauma center, she has been listed now in serious, moved up from critical condition. the 11-year-old boy, though, that was shot is still listed in critical condition. there are reports that he was shot in the face, her in the arm. and police saying that it was a 12-year-old boy who walked into this gym with a shotgun. it was a cold morning in roswell. people were waiting in the gym before classes started. walked into the gym and opened fire. >> is there any word on possible motive? >> reporter: it is possible. we're hearing from people who knew the kids, and who witnessed the shooting, and that it may be a case of bullying. now, whether or not the kid, the child who had the shotgun shot the person who actually bullied him is unknown, whether or not the girl was involved or not in this is unknown, as well. but it is possible that bullying may be at the center of this. anderson? >> do

miguel marquez is tracking the developments for us right now. miguel, what do we know? oh, he lost his ear piece. let's move along. as soon as we see miguel, we'll ask him as we wait for that news conference. oh, here we go. i hear you, miguel, go ahead. >> reporter: what we know happened so far is that 8:00 a.m. in roswell, new mexico, a student walked into that school. we believe it was with a shotgun and shot two other students, critically injuring them. a 14-year-old boy and a 13-year-old girl were both air lifted from roswell to lubbock, texas, to a level one trauma center, where they are listed in critical condition. the one piece that we don't know for sure is whether the shooter himself was shot. police are saying he was apprehended or arrested, but they are not saying whether he gave up willingly or put his weapon down or whether they had to take him out in some way in order to force him to give up. this is a school where sixth to eighth graders go, amazingly enough, shockingly enough. that would put these students anywhere from 11 or 12 to 14 or 15 years old.

miguel marquez, cnn, denver. >>> so here is the quandary for you.hen pot was illegal, it was easy to recognize who was breaking the law. if you were selling or using it for fun, you could be busted. now it might be more difficult since people can grow their own at home and even give it away for free. tom rains, former state prosecutor, now director of colorado district attorney's counsel joins us from denver. break it down for us. while this is legal, to a degree, it still has to be, the law has to be enforced. use of pot still has to be enforced. how difficult will it be to do that? >> you know, fredricka, there are numerous challenges, whether you talk about driving or just possession in general. folks really need to understand their rights. obviously under the current law now, an individual can have one ounce of marijuana in their possession. if they have more than that, they're committing an offense. it is a low level offense at the beginning but can work up to a felony if they have way too much, over 12 ounces. as far as driving, your report me

i'm miguel marquez in new york. we can now put a face to the name of the maryland mall shooter. police just released this photograph of darion marcus aguilar, 19 years old from college park, maryland. he walked into a mall yesterday in columbia, maryland. he had a shotgun and two homemade bombs in a backpack. he shot a woman and a man to death in a store, then he killed himself. police still don't know his motive or even if he knew 21-year-old brianna benlolo or the 25-year-old also killed, tyler johnson. cnn's erin mcpike is outside the mall now. >> reporter: miguel, at a press briefing within the last hour, the police chief said that they did find a journal in aguilar's home in which he expressed general unhappiness for his life. but they still have no known motive. the gunman, now saturday easterfying shooting at this mall in columbia, maryland. >> darion marcus aguilar is the shooter. >> reporter: police still aren't talking about a possible motive. although they say the 19-year-old aguilar lived in the same college park, maryland, neighborhood as one of the victims, 21-year

miguel marquez has the latest. >> reporter: christine, john, it has happened again. 13-year-old girl identified as kendall saunders is in stable condition according to one authority. she was hit in the right shoulder. an 11-year-old boy doing much worse, in two surgeries now and still in critical condition. he suffered wounds to both his neck and face. authorities saying that at 7:30 in the morning at berrendo middle school in roswell, new mexico. the 12-year-old shooter walked into the gymnasium with a shotgun, a .20 gauge shotgun with the stock of it sawed off. that's a smaller caliber shotgun than, say, a.12-gauge shotgun. a quick-thinking teacher stepped up during the shooting. police say his back was to the shooter. he turned as another round went off an walked towards the shooter. literally as the shooter was bearing down on him ordered him to put the gun down. the kid did. and an off-duty police officer came along and helped subdue the shooter. investigators are looking into the possibility that some students at berrendo middle school may have known this was h

our miguel marquez joins us from los angeles with more information. we understand that there is at least a suspect in custody and two students who have been taken to the hospital. what do you know, miguel? >> reporter: yeah, and it sounds like that suspect who is in custody was not shot, is not clear whether he gave up or police had to take him out in some way. we know that a little after 8:00, new mexico time, that this young person walked into berrendo school, a middle school there. this is in new mexico, typically fifth through eighth grade, so it's shocking to think of the possibilities here. shot and injured two individuals. they were taken to eastern new mexico medical center there, a level three trauma center. there are some reports that there may be a third victim who was airlifted to lubbock, texas, which would have a higher level trauma center. so we'll keep our eye on that. roswell is a fairly small town, about 50,000 people in southeastern new mexico. the school itself is north of the city, it looks to be in a fairly new area or part of th

"rich hill" is one of them, a very eintimate of the wrong sid of the tracks. >> who are these characters? >> andrew, harley and apache, young kids coming of age. they are like a lot of american kids but struggling to survive. >> it is hard to watch at times but you also feel it is emotional. you feel for them an you feel a little hope at the end. what's the takeaway? you guys worked two years on this film. what did you take away? what did you come away with? >> for us, how much love is in these homes despite having so little. i found that beautiful and touching and continually surprising throughout production. >> the other thing that's amazing is that these individuals are coming here to sundance. first premier of this film is sunday night. they are coming her
