mike: great! if this was the cleanup guy and michael cohen pleads guilty does it mean candidate trump did anything illegal, sir? >> i do not think so. and it is mainly because the campaign finance laws work differently depending on what your status is good for example, as a candidate, president trump did not have any dollar limit on what he was able to spend on the campaign. they are very technical laws the campaign finance laws and the president is not a lawyer. michael cohen is a lawyer. it can be very difficult for prosecutors to establish criminal state of mind for the president. mike: how big is the burden of proof for government prosecutors? >> well, this particular statute, all of the criminal provisions of the campaign finance laws require the government to prove beyond a reasonable doubt that the defendant acted willfully. willfulness is the highest mental standard of proof in the criminal law. it really almost defies the old adage that it is no excuse. i think it would be very difficult when you're dealing with somebody again, who is not a lawyer, who did not need to be thinking about do
