. >> dana: there was reporting this morning that mike flynn, who has plead guilty, is possibly being encouraged to change that plea and withdraw it based on something that a judge said this week. can you explain that? >> well, mike flynn is in a difficult spot because even if he's thinking about withdrawing his guilty plea, it's not as simple as notifying the court. it is an uphill struggle for a defendant to convince a court after having plead guilty that there should be some reconsideration of that. he's been cooperating in the probe. that much is very clear. so this would be a real abrupt about face. it's not by any means automatic if you pursue it. in fact, most of the time it's almost an automatic no to withdrawing the plea. >> dana: andrew mccarthy wrote today that it appears sullivan's order supercedes the plea agreement and imposes on the special counsel to reveal any and all evidence that flynn is innocent to the charge which he admitted guilt. is he right on that? >> he's right, but incomplete. he's very knowledgeable, says good things about the criminal justice system. the

george papadopoulos and mike flynn.f this report is right and mueller is going to get a third witness, that's major advance in the special counsel's position in this investigation. that said, i'm not a lawyer and there is part of this reporting i need help. i need help understanding this part. this is cnn's report tonight quote. gates' has already spoken to mueller's team about his case and been in plea negotiations for about a month. gates' had what criminal lawyers call a queen for a day interview. what on god's green earth is a queen for a day interview? it sounds awesome. is this like -- all right. gates has had what criminal lawyers call a queen for a day interview in which a defendant answers any questions from the prosecutor's team including about his own case and other potential criminal activity he witnessed. in a queen for a day interview, a defendant can typically admit to crimes with little additional consequences unless he or she lies. after the queen for a day interview, there is only a small chance a defe

for context here in contrast, the cooperation agreement that mueller did with mike flynn, that puts mike flynn's jail risk at zero to six months. what's hanging over rick gates right now is multiple years starting right away and he's already signed for it. so this cooperation deal that he signed today, these two charges he plead guilty to, this is put together as a very serious package for trump's deputy campaign manager. and it therefore puts a huge spotlight on what gates could possibly give mueller for his on going investigation and here is the part of it that i think is really important and i will just say so much of this is happening so fast that i'm not sure this really important part of it has sunk in yet. but after marinating in these legal filings and reporting today, in my opinion, i think this is the most important piece. in yesterday's indictment of manafort and gates, special counsel's office spelled out in intense detail a two-part scheme by manafort and gates. part one we already knew about from the first time they got indicted back in october. part one was the older stuff

that's mike flynn's replacement. that is the man, right, talking about the investigation that got a guilty plea of his predecessor. and then you look to the skepticism, which we always cover all sides and reactions here. there is a skeptical view in the united states, particularly among some trump allies of what does it even mean to indict foreigners and is it really a big deal? you have done this before. does it matter? >> well, it matters in a whole host of different ways. one, it could matter because you're bringing people to justice from overseas. and as long as you have jurisdiction here in the united states, based on their conduct touching upon the united states, then that's obviously the number one primary goal. but second, you have two other potential goals. one is what we would often call naming and shaming. in this case, where you don't really expect to get anyone in court. you don't expect to arrest anyone. the united states does not have an extradition treaty with russia. and russia will almost certainly

mike flynn pleads guilty to lying to the fbi in december. guilty takes himself off the case. why? because that judge is also on the fisa court. and he may, he may very well have authorized the wiretap that surveilled mike flynn when he was talking to then ambassador kislyak, which is the alleged lie that he told the fbi about. so mike flynn pleads guilty. a new judge comes. in it's time for sentencing. bob mueller says we don't want to sense him until may that's normal. if you have a cooperatingens with you don't want to sentence until after the cooperation is finished. then the judge on his own, not in response to any application from a general flynn's lawyer says by the way, i want all exculpatory evidence, evidence that could help flynn or hurt the government turned over, pardon me to flynn's lawyers. why we want that after general flynn has already pleaded guilty? that is unheard of. he must suspect a defect in the guilty plea. meaning he must have reason to believe that general flynn pleaded guilty for some reason other than guilt. do p
