in the special counsel case, and they specifically focus on the former national security advisor mike flynn them one at a time. the first one has to do with his cooperation agreement. and it explicitly states that flynn cooperated with the special counsel and provided information about phone calls that he received from individuals connected to the administration or congress before and after his guilty plea that would have, quote, affected his willingness to cooperate and the completeness of that cooperation. it goes on to say the defendant, flynn, even provided a voice mail recording of one such communication. the next record i have here is what i describe as one of the so called mccabe memos, memos that were written by the former acting fbi director andrew mccabe, and this memo describes the decision making leading up to flynn's fbi interview about his conversations with the russian ambassador that ultimately led to his termination for lying. and it states very clearly here that mccabe instructed flynn that the quickest way to get this done was to do the interviews without involving the sp

in the prosecution -- that plea deal that blew up when he started lying to them, the handling of mike flynn, including the warnings they got from the justice department about flynn being compromised by the russian government, hush money payments paid to women before the election, right. 36 different things. and, you know, we have heard a whole bunch of noise from the president and the white house about blocking don mcgahn from testifying in congress. but the other part of this subpoena to don mcgahn is this humongous 36-part demand for documents from don mcgahn. and the deadline on that one is tomorrow morning, tuesday, may 7th, 10:00 a.m. and, again, the white house is probably up a creek without a paddle here if they are going to try to assert some claim of privilege to try to stop don mcgahn from handing over these documents. don mcgahn already discussed these matters and presumably handed over all these materials to mueller's investigators. if it wasn't privileged in that instance, it's not privileged for anybody else. we also know from mueller's report that don mcgahn is a note-taker.

rob is rob kellner, the lawyer for the former national security adviser, mike flynn.t is close to what the special counsel report in the obstruction chapter in the voice mail according to do you do, he says that it was not meant to intimidate. it was a longstanding relationship with hellner and he said what people need to understand is that they had what is called a joint defense agreement between flynn and the president's legal team. so there was a broad sharing of information. some of the information would have been sensitive or privileged. he told me that the motivation nor the phone call was to say to flynn's lawyer, if you're going to do a deal, we want a heads-up. because some of this material is sensitive and privileged because of the communications with the president. the other thing i want to say, charles, looking at the order from the judge, my read is he asked for two sets of documents. not only the transcript of the voice mail, which was part of the obstruction volume in the special counsel's report, but more significantly i think the transcripts of phone
