that would be people like senators josh hawley, in mike lee and ted cruz.ht have seen the news earlier this month that major league baseball, again, private business, decided to move its all-star game out of georgia in protest of that states new restrictive voting law. again, i think you can all agree, major league baseball has the right to do that. that is core constitutionally productive activity. they can put their games where they want to, and they can move games for political purposes if they want to. now what the first amendment does not, allow is for the government to punish them for that speech. think about it. we don't want a situation where we had a tax code that was say corporate tax rate 25% in companies that expressed this certain political view, we will make it 30%. you can't do that. that's discrimination by the government using the tax code or regulation or anything else as punishment for coercion for protective political activity, is explicitly not allowed in first amendment for good reason. and yet senators josh holiday and ted cruz and mi

. >> my good friend from law school, been friends for 30 years, is senator mike lee. we have both served together as prosecutors and the federal system. he said he is engaged in criminal justice reform not despite being a conservative but because he is a conservative. and because we've seen -- we have seen the criminal justice system -- if you believe big government is inefficient and all other areas except the criminal justice system, you have a rude awakening when you actually pull up the curtain and look what is back there. because there are aspects that are broken and they will only get fixed if conservatives step forward and say, i will do that. is it possible in congress to still do that as a conservative or is it so dysfunctional we will not be able to do that? >> something for six years i made our staff and team answer was this question. is it simply about making the argument or is it also about making a difference? in 21st century conservatism, either way you face it, we are challenged now not only to be conservative champions but also to be bridge builders.

your reporting shows he made some donations the last quarter to senators mike lee and rand paul, kindlibertarians, but not to his colleagues in the house. does that tell you anything about his strategy and how he is trying to keep the support of his republican colleagues? >> well, gaetz titled his book "firebrand" in september and he sees himself as a rogue who can float around d.c. as a partisan free radical at times. it doesn't seem to hurt him among his colleagues. he embraces not having friends in the swamp. he didn't give money the first part of this year to anyone in the house and he also didn't get money from anybody in the house, jim jordan didn't give to him. he did, however, give $5,000 each to some florida state senators. and four of them are on the agricultural committee. one is on the health committee. and cnn reported just recently that medical marijuana is a focus of this investigation, and whether some of these escorts, these trips were allegedly provided to gaetz as part of an influence program over medical marijuana. >> that has been a sort of pet issue for gaetz in

let me circle back to you, mike lee. what are your things to buy here or outperform?> i still like all of the major retail names in terms of target, home depot and lowe's. i don't, i think they're going to blow away earnings. i don't know that they necessarily have the upside that some of the other names do. i think sales force has not performed well even though having great earnings. i can see them beating, raising and coming out with an outlook that beat street expectations. owning that new their earnings call could be potential for a huge winner. the other name in technology i like, they don't report for a few months is oracle. if you remember we talked about oracle in maybe november or december. it hasn't moved the way a lot of other technology names have moved. since then it has been on a tear. i don't see that stopping. it is still lagging other large cap names and circling back to what we talk about treasury rates. if rates stablized the growth trade is on. the market needs more evidence of that before it goes all-in on the growth trade. charles: we're running
