according to "politico," mike murphy was the man behind several pro gun reform ads produced for michaelloomberg's gun group. murphy reportedly worked on spots defending republican senator pat toomey and this ad which is critical of democrat mark prior. >> when my dear, innocent friend was shot to death, i didn't blame guns, i blamed the system that makes it so terribly easy for criminals or dangerous mentally ill to buy guns. that's why i was disappointed that mark prior voted against comprehensive background checks. on that vote, he let us down. tell mark pryor to take another look at background checks because we're tired of being disappointed. >> murphy defended his role in the ads saying, i'm proud to support comprehensive background checks just like the nra did in '99. >> mike murphy, obviously, has been a guy that has supported candidates that win. and he's won some races. and i suspect that it's going to be people like mike murphy that are going to help us as a republican party get the middle of america back again. but, still, he's going to be hounded for the rest of his political

go ahead. >> chuck, it's mike murphy.th the stock price down 23 plus percent year to date, has there been talk or are you in the midst of a stock repurchase program? it looks like the numbers you put up during your quarter were pretty good across the board. if you take out what gold has done -- and i get the price of gold has corrected quite a bit and as you say recovered -- but it would seem with cash out there, it might be a great time to start buying back some stock. >> well, as i said, we are quite profitable at these levels. and we did have a good quarter. we are investing right now. we're building three new mines around the americas, and that's what drives that 70% growth profile that i talked about. and so for this year at current gold prices, we're not in an excess cash flow situation, but we expect free cash flow starting next year, 2014, and for several years thereafter. looking at how to allocate that excess cash is a critical issue for us. and whether that is in new projects, increasing our dividend, which we

we're trading all of today's market action with pete and john, mike murphy. first, let's go right for some breaking news regarding the nasdaq and facebook. >> the sec is bringing a $10 million fine against nasdaq. this is the largest fine ever against an exchange. it comes in addition to the $62 million that nasdaq is already paying to cover losses of investors during that ipo. losses were about $500 million during that ipo. of course there's limited liability for these exchanges. a lot of people think even the $10 million fine, even the largest ever, is still pretty small, but it is the end of the road for the sec's investigation of nasdaq. they found that even though nasdaq executives convened a code blue conference call, they decided not to delay the opening of facebook shares. and that they failed to execute several orders for nzinga shares that they assumeled a short position that they ended up profiting on. those were among some of the errors that were -- that occurred during nasdaq's execution of the facebook ipo. the sec ordered several more errors bu
