mike. this morning a third challenge to stop prosecutors from showing a video and sheriff mirkarimi's domestic violence trial. christie smith is live in san francisco with the newest defense tactic. good morning. >> reporter: a couple of things, jury selection continues after the jury pool was expanded but the state of a video that is the key to the prosecution's case, well, it's still up in the air after attorneys for san francisco sheriff ross mirkarimi, they are still fighting to have it kept away from jurors. a panel rejected a claim that mirkarimi's wife made the video with a neighbor who she thought apparently was a lawyer, the argument there that it should be kept out due to attorney-client privilege. the video show as bruise on her arm and accuses mirkarimi causing it. he has denied any assault and lopez has said she was not abused and refused to testify. his attorneys claim that an unavailable witness would violate his right to question his accuser a. ways to go in this. there are 144 potential jurors still to question. reporting live in san francisco, christie smith, "today in the bay." >> thank you very much. the

mike, we start off with breaking news in san francisco. police remain at the scene of a homicide which appears to have happened just hours ago. christie smith is live on the scene with the latest details. good morning. what's happening out there? >> reporter: good morning. i want to step aside real quickly and show you where the body was found this morning. up under the tree that's mid-way on the block on the sidewalk. just wanted to mention too. main street is back open. they just pulled down the police tape that had been up here all night. but two homicide inspectors keep coming and going. we saw them question a man sleeping in a tent across the street from where the victim was found. police say they got a call of a body on main street near bryant and harrison. this is right under the bay bridge. they are investigating this as a homicide but have not said how the man died. we did have a chance to walk closer to the crime scene. there is broken close nearby on the ground. there were reports that this could have been a pg&e worker involved. there was a pg&e truck near where the victim was found, but i had a chance to speak with pg&e this mo

the bay's christie smith live at city hall where major ed lee is expected to make some kind of announcement today. christie, good morning. what's up? >> reporter: good morning, mike lee is expected to talk about this domestic violence case and the future for sheriff ross mirkarimi, even though mirkarimi has said he wants to keep his job as sheriff and doesn't want to step down despite pleading guilty to false imprisonment after an alleged new year's eve altercation with his wife. mirkarimi was sentenced yesterday to probation, counseling, and a $600 fine. now a tape showed his wife bruised and tearful after this alleged incident. mirkarimi met with lee after the sentencing for about 15 minutes yesterday. but when he left, he didn't say what it was all about. what could happen here is that lee could start the process to remove mirkarimi from office but ultimately, it would be up to the board of supervisors. after the sentencing, mirkarimi said he's trying to regain the public's trust. >> and i'm going to devote myself to repair my relationship with my family, with the people of san francisco, and i'm committed to becoming a better public servant, one you can be pr

mike, thank you. it is 6:01. no doubt about it it's going to be a noisy one on uc-berkeley campuses as students join a day of action against cuts to higher education. christie smith is live with more on the protests. good morning. >> reporter: good morning, jon. it's pretty early for students to get started but in about 90 minutes they are heading over to california hall here at uc-berkeley to kick off this strike for public education. they say they picked california hall because that's where a lot of the decision makers work at uc-berkeley. when occupy cal activists were set up they told us that really what they were doing was leading up to this march 1st day of action. this day and then the next few days. they say they refused to accept massive tuition hikes and outrageous loan debt while banks make record profits. a number of bay area colleges and universities, today this is going on up and down the state. students and faculty at cal plan to have classes outside instead of inside, a noon rally, then a march to downtown oakland near city hall where they will meet with more activists, more students, this again, leading up to another march on monday to the state
