miller: mr. speaker, i rise in opposition to h.r. 5, the letting students down act. h.r. 5 is supposed to be the re-authorization of the elementary and secondary education act, and a rewrite of no child left behind. the elementary-connectedary education act was born out of brown v. board of education. it is our nation's education law, but it is fundamentally a civil rights law. h.r. 5 runs our country in the opposite direction from those civil rights promises. this bill guts funding for public education. advocates the federal government's responsibility to ensure every child has an equal opportunity to a quality education and it walks away from our duty to hold school systems accountable to students, parents, and taxpayers. for decades providing all children with the quality education has been considered such a critical national priority that we have always found a way to come together in a bipartisan fashion to re-authorize and to update the elementary, secondary education act. we all recognize

miller: mr. speaker, i claim time in opposition. the chair: the gentleman is recognized for five minutes. mr. miller: mr. speaker, i rise in opposition to the schock-meehan amendment because it really is a political exercise. it fails to fix the problems of h.r. 5, letting students down act. the amendment is an ideological attempt to keep -- to give school districts more control but actually doesn't do that. it just creates more paperwork, more bureaucracy at the federal level like consultations and chances to dispute regulations, all of which many of which are already allowed in federal law but this would be a different subset to require that. i've been here a long time and i can't think of any administration that gave both states and local school districts more options, more flexibility, more ability to design the systems under which to work than the obama administration which there is 37 states who've undertaken race to the top which gave them great flexibility and there's 40 states that have

miller: mr. chairman, this amendment is not about a good education. this is an amendment suggesting an approach that in fact the amendment doesn't enable to happen and that is the idea that a student can choose the school under the guise of portability when in fact it doesn't set up any mechanisms for the students to do that. the suggestion here somehow is students t that the will make this choice -- parents will make this choice. we had the right under no child left behind for students to elect to go to any school in the district they sought to do that. of course, what we have found out is that in many instances it's less than 2% or 3% of the parents make that decision and they don't -- the reason -- many reasons why they don't do that is in fact it's a decision that doesn't work for them because of lack of transportation in poor neighborhoods, lack of issues of personal safety of the students. the difference in my districts and some parts of my district going to the school next to your home and

carol miller couldn't see.to her dog bunny, miller and seven cats survived a fast-moving fire. >> if it hadn't been for her, we all would have died. it happened that quickly. >> reporter: but more than 90 cats did not make it out and died. miller's home in south san jose served as a sanctuary for cats who had been trapped on the campus. >> they're my life. they're my life. i'm okay as long as i don't think about the individual cats, because i still have seven kitties and a little doggy who saved all of us. >> reporter: miller had applied to san jose animal care and services to be a rescue service but had been turned down. a large part of that had to do with the number of cats in her home. >> we saw how many cats she had. even though the care was good, we felt the work she was doing for stanford was enough. we didn't want the add to that in partnering with her. so we declined. >> reporter: while the city of san jose has a five-cat limit, it come downs to how well you take care of the cats. >> really, to do somet
