witnesses tell milwaukee police it started with an argument that turned into exchange of gun fire on a porch. i want you to notice the red car at the curb backing up. you have a guy in the white shirt with his hands in his pants and the driver. the driver gets out and it appears they get shot at somewhere off screen and you see the driver return fire. the g in the white tries to get behind this wall. if you slow it down you can see his head. seems as if he took a graze here. >> instead of getting back in the car, the man firing the gun runs away. notice the guy in the white t-shirt. he holds his head, looks at his hands and gets in the car and starts driving. at one point you see a passenger in the passenger seat. it is unknown what his role was in the whole incident. >> any idea, the guy was holding his head. any idea if he showed up at a hospital. >> police don't know if he sought treatment but they say that one person shot in the head, grazed in the head and obviously it wasn't so serious he couldn't drive away. >>> technology evolves. we get differing and better views of the worl

the infamous case in milwaukee, jeffrey dahmer, police took somebody held by a mass murderer and handed mass murderer. hopefully the clues weren't quite so clear, but there are serious questions about whether the police are nosey enough. need to be nosey properly. sometimes they're criticized for being overly aggressive, but certainly in a situation like this, it is a horrible thing to think any of these ladies could have been rescued earlier if the police had been empowered and willing to take the extra step and go the extra mile and to intervene. >> and keep in mind, this is cleveland where in 2009, just a few years ago, 11 bodies were found in the home of a serial killer, and a lot of victims were poor black victims, and the mayor in the wake of that recommended the city overhaul the investigation into missing persons. it seems as if that overhaul was not done or certainly there would be questions about the efficacy of that. >> it goes beyond cleveland, it is clearly a class and race problem. there's a sigma to mental health issues, people don't always feel comfortable, there's embar

milwaukee area. joining us tonight is david clark, who has been on the police force since 1978, sheriff since 2002. how bad is the drunk driving program in milwaukee? >> it is problematic nationwide. it kills over 10,000 people a year. is struggling with it in some way, shape, or form. so far had 610 arrests in 2013, through may, and, to give you an example, at this time last year, we only had 315. we merely doubled the limit. doubling a lot of people we arrested for impaired driving. >> what do you think is behind the numbers? >> in wisconsin, we have a couple of things working against us. wisconsin the only state in the nation that does not criminalize the first offense of drunk driving. in your first offense, you get arrested, but you get a ticket. you pay a fine and that is the end of it. 49 states, it is a criminal misdemeanor. to drive impaired or to drive drunk. what we are having a problem with in the state of wisconsin, and every state is unique, the problem we are having is with repeat offenders. in 2010, with more stringent laws going into effect for repeat drunk drivers, we arrested 970
