a plea deal was been reached in the ross mirkarimi trial. it happened late this morning, the sheriff pleaded guilty to one count of false imprisonment. david stevenson is live with more. david? >> reporter: we've learned the agreement between prosecutors and mirkarimi's defense team was reached last night. the sheriff pleaded guilty to one charge wiping away the other charges in the domestic violence case. now, mirkarimi was charged in january with misdemeanor domestic violence battery after a december 31st altercation with his wife. both denied there was any abuse. the prosecution's key piece of evidence was a 55-second video in which his wife tearfully displayed a bruise on her arm. the deal was announced as 144 potential jurors were set to be interviewed this morning for the trial. now, here are the details -- an exchange for prosecutor's dropping the original charge, mirkarimi pleaded guilty to misdemeanor false imprisonment from having kept his wife from leaving their home immediately after the altercation. he will be sentenced to three

san franciscoens want sheriff ross mirkarimi to step down. poll finds a solid majority, 61% want him to resign. less than a third want him to stay in office. and if he doesn't quit, more than half want city leaders to take matters into their own hands and force him out. it's the kind of information that the mayor told linda yee he needs before making any decision. >> even after his plea deal, sheriff ross mirkarimi insisted he would not resign. our poll shows the public thinks otherwise. >> he's upholding the law. if he's not breaking it, i don't think the two go together. >> the sheriff insists he can still do the job. that hasn't been the opinion of mayor ed lee. >> obviously i had asked the sheriff to maybe take a voluntary leave so that it wouldn't be connected to the operations to the office and he made his decision not to do so. >> the mayor can suspend mirkarimi for official misconduct. but mirkarimi cannot be fired without an ethics committee recommendation and nine supervisors agreeing. the mayor says he is weighing public opinions.

mirkarimi is facing an ethics investigation. >> this could go on for weeks. today the mayor is expected to file its official misconduct charges with the san francisco ethics commission and after five days, that commission will begin the process of making a recommendation to the board of supervisors. we could see weeks of hearings on this. mayor lee suspended ross mirkarimi yesterday after he pleaded guilty to a misdemeanor charge of false imprisonment involving a domestic violence charge with his wife. the mayor met with mirkarimi on monday and asked him to resign but the sheriff refused. >> i do not believe that the concept i have taken constitutes official misconduct within the meaning of the law and i look forward to making my case to the ethics commission and the board of supervisors >> i've carefully reviewed the city charter and conducted my own review of the evidence and consulted with legal counsel. i also met with sherrif ross mirkarimi yesterday to give him the opportunity to resign. >> though the ethics commission will hold hearings on the miscondu

ross mirkarimi will serve three years of probation.ne-day prison sentence will be marked down as time already served. today's sentencing is the result of a deal last week in which mirkarimi pled guilty to a false imprisonment charge. prosecutors claim the sheriff bruised the arm of his wife, lopez, during a new year's eve incident in the couple's home. today sheriff mirkarimi addressed the media. >> i do not believe domestic violence is a private family matter. i never thought it was, and if i ever had suggested it was a misstatement. >> we've learned the sheriff met with the mayor following the sentence. he plans to make a public statement about the case tomorrow. >>> well, we seem to hear it every year, a politician who finds himself or herself in trouble either because of running afoul of the law or because they somehow flout against moral conduct. how do these affect the official and how the voters perceive them? let's bring in larry gerston. arnold schwarzenegger, gavin newsom, now ross mirkarimi. when we see some of these people,

it could speak to sheriff ross mirkarimi's character. the hearing just wrapped up. but it's not finished. one of the lawyers had a conflict and had to go take a flight so the hearing is going to be continued now on monday at the same time as jury selection. the ex-girlfriend christina flores, these are the only pictures that we have of her. flores was allowed to enter the courtroom in secret. today's hearing was then going on behind locked doors. the judge and the attorneys spent the morning questioning her about her stories of abuse at the hands of ross mirkarimi when they dated a few years ago. flores filed a police report about it after she heard about the bruise he is accused of giving his wife. she said mirkarimi was prone to violent outbursts and once bruised her arm, as well. the statute of limitations has expired. so it's not a criminal issue. but if that testimony is allowed, it could be make or break. >> i think the jury hears that and the jury makes a judgment about mirkarimi. the judgment is he is someone capable of this. whether or not they believe that

that is about san francisco sheriff mirkarimi. seems to not be able to not have unwound himself from this case involving his wife and domestic violence. >> right, i mean, there always seems to be something new all the time. this week we found out ross mirkarimi, facing three criminal charges of misdemeanors stemming from a case of alleged domestic violence on new year's eve, he decided in a plea bargain with prosecutors to plead guilty to a lesser charge of false imprisonment. he had been facing domestic violence, battery, dissuading a witness and child endangerment because this alleged incident took place in front of their 2-year-old son. they decided to have a plea bargain agreement, he'll be sentenced monday. this case just keeps going and going and going. jury selection had been under way already. they had close to 450 potential jurors in the pool. only about 150 left. a lot of the people have heard about this case. even after sentencing monday, we aren't sure if that's the end of the story. i'm pretty sure it's not the end of

in the ross mirkarimi case. both sides are preparing to question potential jurors on monday but today we got a sense of the domestic violence expert who a judge today said won't be allowed to testify in the case. uc berkeley law lecturing and nancy lemon learned this afternoon that she will get to testify in the case of mirkarimi. after a december 31stparty. lemon can testify about the behavior of batterers and why women remain in abusive relationships. mirkarimi's defense worked to get her to testify. mirkarimi and lopez have a 2- year-old son who witnessed the abuse. prosecutors could use a 55 second video that shows lopez displaying a bruise allegedly caused by her husband. mirkarimi's defense worked to oust that video, given that lopez will not testify. >> you cannot cross question a video. you can't ask a video what happened before and what happened after. >> reporter: jurors are said to be questioned on monday with opening arguments possible by late next week. the judge in this case still must take on a mo
