monte francis is live at candlestick park with what happened. monte, good morning. >> reporter: good morning. one man was attacked here in the parking lot and three suspects are now under arrest. but this is far from a closed chapter for the 49ers. there have been several fights here at candlestick. some inside the stadium and some out in the parking lot. many of the fights broke out during the preseason. in response the nfl's head of security came to san francisco two weeks ago to evaluate the effectiveness of security measures here at candlestick. the team has also since banned tailgating after kickoff. the most recent fight reportedly happened at the 49ers games last sunday against dallas when a man stood behind a truck in the parking lot blocking it from backing up. that's when the occupants of the truck attacked the man, hitting him in the head with a bottle and a flashlight. a friend of the victim stepped in and he was punched in the head. a security guard then intervened and was also attacked. the good news here is none of those injured we

nbc bay area's monte francis is in oakland with the very latest for us. monte? >> reporter: diane, this new list means that five schools that were on the chopping block now are not, but five others are still slated to close, and here is the list. they are all elementary schools here in oakland. they include lakeview, lazear, marshall, maxwell park and santa fe. a final decision is expected tuesday. there was a ribbon-cutting ceremony at oakland high school recently renovated to include an on-campus health center. we talked to a unified spokesman who explained that the $25 million in bond funds used to renovate the high school could not have been used to spare other schools in the district from shuts down. >> the language states explicitly that money has to be used for renovation of existing school sites. it could not have been redirected to keep schools open. >> reporter: troy flint also said it's not just budget constraints forcing the districts to close schools. ice also declining enrollment. three weeks ago, the district posted a list of eight elementary scho

monte francis, nbc bay area news. >> thank you. a police officer arrested for allegedly having improper relations with two teenage boys its out of jail. the 44-year-old was released from santa clara county jail after posting $100,000 bail. he was arrested yesterday by gilroy police when he showed up for work at san jose police department. he now faces three counts of child molestation. police say he allegedly mope-- molested the boys, ages 15 and 17 at his home in gilroy. a san jose spokesperson says heap is on paid leave and the department will conduct its own internal investigation. he was one of two suspected police officers accused of covering up a dui crash of a fellow police officer. he worked as a campus police officer. >>> san francisco police are stepping up their patrols of the mission district following two deadly gang shootings earlier this week. one of the victims was mistaken for a rival gang member and shot outside the restaurant where he worked. a second victim, suspected gang member was shot the same day, presumabl

monte francis spoke to the mayor and joins us live from san jose city hall. what's next for the dozens of pot clubs in san jose? >> reporter: well, there are about 130 medical marijuana dispensaries here in san jose and the mayor is saying 120 of them will have to close or relocate. but pot club owners are vowing to take this fight to court and to the ballot box. amsterdam's garden is one of dozens of medical marijuana dispensaries in san jose that could be forced to close if it doesn't get one of the ten coveted permits allowed under a city ordinance passed last night by the city council. >> i think it's incorrect for them to go about trying to restrict something that doesn't -- that they don't really know that much about. >> the state has not given us much guidance, the federal government says it's illegal so we're trying to figure out the way to go and this is a good way to start. >> reporter: in addition to limiting the number to ten, the ordinance requires pot clubs to grow their own product on site, sell it in childproof containers and also have a docto
