monty francis is live with details. >> reporter: good evening. you can still see evidence of the america's cup competition from last summer. the mayor has said he would like for it to return, but now there's some serious doubts about whether that will happen. san francisco entered into negotiations with larry ellison's winning team last month to bring the rigata back to san francisco in three years. >> we would love to come back to san francisco. it's a beautiful place. we're going to talk with the officials in san francisco and see if that's going to be possible. >> reporter: but today, the team's ceo told the associated press they're considering other venues, because san francisco officials don't want to offer the same deal as last time. >> it brings many different types of people to the bay area to watch the event. i think it brought in a lot of revenue also, so it was a win-win situation for everyone. >> reporter: but supervisors felt the last deal was too generous to organizers and critics said the economic benefits were overexaggerated. the

monty francis is in millbrae with more on that for us. >> reporter: good evening. at the beginning of the day, this walgreens had about 30 doses of the flu vaccine on hand. this afternoon they ran out. now it will be monday before they can get more. as far as we can tell, this is not a widespread shortage, but wall greens and cvs acknowledged some of their pharmacies are running low or run out of flu shots because of high demand and it would take 48 hours to replenish the supply. state health officials are urging people to get the flu vaccine, citing a series of deaths resulting from the h1n1 virus. also known as swine flu. seven bay area counties, plus santa cruz county, have reported collectively more than a dozen deaths so far this flu season. the most recent victim was a 23-year-old man from sonoma county with no underlying health problems. in fact, all of the victims so far have been under the age of 65. but despite that, many people say they still aren't planning on getting vaccinated. >> i do worry about it. it's my community. i think it's personal if it's f

live in san francisco, monty francis, nbc bay area news. >> thanks. children's hospital oakland has been steadfast in its refusal to put in a breathing tube or feeding tube which seemed necessary for any possible move to any facility that wasn't a hospital. kimberly, you've been covering this story almost from the beginning. what do you gather is going to happen next? >> i believe it's what monty said, the family has been waiting to get jahi out of this hospital. they are going to bring her to a place to get the tube put into her before she's transported to whatever facilitatecy is doing to headache her. she was taken away by an ambulance company based out of alameda. a statement wuss leased that the body was released to the coroner. the coroner has released her body to destinations unknown. we wish her family closure and peace. request for children's hospital to come in were denied. the family and attorney for children's hospital had a hearing in federal court for tuesday. but the hospital says it likely won't be necessary now that she has been moved

monty francis joins from us the scene. i believe this is the same area that had a major fire a few weeks ago. >> reporter: raj, that's right. good evening. the spare the air alert, the first in two weeks, unrelated to this fire. but this fire that bumped more than four hours this morning did not help. you can see a smoky haze hanging in the air as firefighters finish up their work. this is also the third industrial fire here in this area in recent months. and that is raising questions and concerns from people who live nearby. the fire started just below 6:00 this morning, ripping through a machine shop and spreading to three nearby buildings, including an apartment complex. the machine shop did not have sprinklers and it took more than 100 firefighters until 10:30 to get the flames under control. meanwhile, a huge plume of smoke went up into the air, slowed traffic on highway 101, and made it hard to breathe. >> if you are walking or working, you cannot breathe really good. because you can smell the smoke, feel it coming i
