david moore is a graphic designer from morehead, kentucky.nd his partner, david ermold, were denied a marriage license on three occasions by kim davis and staffers in her office. his voice is the one you just heard on the video we just played, arguing kim davis. -- goneeo has gone myra viral. more than 1.8 million hits. chris hartman is the director of the fairness campaign, kentucky's statewide lgbt group based in louisville. there joining us from lexington, kentucky. we go to louisville to speak who attorney joe dunman represented several in kentucky marriage cases which were consolidated into the supreme court case that effectively made marriage equality the law of the land. david, let's begin with you and lexington. describe the interaction that you had with the county clerk kim davis. where were you? what are you asking for? what did she say to you? >> i was in the county clerk's office in morehead. we went in. press was everywhere. we saw the couple that went in before us who are part of the aclu case. they came out and we saw they were

. >> reporter: hey, erika, it's a miserable rainy evening here in morehead. and we were expecting kim davis to come to work, and she didn't, andhen we were told by her lawyer that it would be friday or monday, and then they said that she will be back at her desk on monday. taking time with her family after losing the labor day weekend. but some are wondering if she'll interfere with the issuance of marriage licenses here. we'll have to wait and see. but why is morehead in the news when two other counties in kentucky are refusing to happened out marriage licenses? a thriving lgbt community with the community. there's no sign that kim davis just spent her first night at home in seven days, but they're looking to get a marriage license in rowan county, and they can, because they can get one. >> if i wanted to get married in rowan county, i did. >> one of kim davis' deputies tells us that he'll go on issuing marriage licenses, even if the boss tells him not to when she comes back to work. but rowan is not the only town in kentucky where marriage licenses are bein

we're covering the action outside the clerk's office in morehead, kentucky. john, her deputies were busy processing paperwork all this morning for couples who had been waiting for licenses for months. i understood you met with the first gay couple to get a license in that county. what did they say? >> first gay couple to get a license since june. first gay couple ever i guess to get a license in this county. first through the doors this morning, it's james yates and william smith. they were, as soon as the doors opened, straight up to the front desk. we caught up with them receiving the paperwork and signing things for their marriage license. they were absolutely delighted, although i think a little bit confused as well, because of all the media attention. they've been to this office five times in the past, stephanie, seeking a license. today they got one. we caught up with just outside the office. as you'll see they're pretty pleased. take a look. >> how many times have you been here before to get a license? >> this is the sixth. >> how are you feeling this

we get more from cnn's chris welch from morehead, kentucky. >> reporter: the police are saying they areing for a large crowd when came davis returns to her job here as county clerk for the first time since being held in contempt of court and spending five days in jail. now the big question remains. will her deputies continue to issue marriage licenses to same-sex couples? that is how it worked while she was in jail. now she is in the office with the deputies, will she continue to allow that to happen or step in and put her foot down and refuse these couples from getting marriage licenses. we had known for several weeks now that her attorneys and she had been fighting this and trying to overturn the initial judge's order. they have not had much success. she sent a direct petition to the u.s. supreme court. that did not work. on friday, her team of attorneys sent another appeal in the sixth circuit and no word from the court. >> thank you, chris. >>> later today, the ferguson commission convened by the missouri governor in the michael brown shooting will issue the report. the panel was is

and now, we go the martin savidge in morehead, kentucky. >> and the question is what will she do when she returns the work. and with are hearing that she may not return until maybe next week. i spoke to one of the attorneys, and he said that basically she needed some time to rest and be with family, and that is what she is doing, clear ly after ths whirlwind that she is undergoing. and one thing that is key is thatter h name is not on the license licenses as it has been since friday, and the licenses are not a stack of pre-printed with her name embedded upon them, and they don't have that demand here, and the way it works is that when you go in and you want your licenses, one clerk may sign them, and she signs as well, but again, her name has not been appearing on the licenses since friday, and the count so far is that there are ten marriage licenses issued in the absences, and seven of them for same sex couples, and that is as of this morning. john? >> and will they continue to issue the licenses without her name or continue to be issued without her name? we don't know, and thank you

gabe gutierrez is in morehead with more. what do we know? >> reporter: hey there, luke.oon. lawyers for kim davis just filed a motion asking a judge to free her from the obligation from her obligation to issue marriage licenses. that is a mirror image to what the judge has already granted, the order directing her to continue issuing those marriage license. now, this is a legal maneuver perhaps but here's the bottom line. that doesn't have a chance of very much going anywhere and the bottom line is she's expected in court tomorrow morning at 11:00 and federal court to explain why she should not be held in con tervet of court for vie latting the order and could face stiff penalties, fines, to even jail time and legal experts say, luke, it's unlikely to face any jail time and opponents don't want that. they prefer to see her fined. but she continues to stand by what she call it is religious beliefs and that this is all about religious freedom and still has many supporters here in the county that were out here today. even though she denied a marriage license to another same-
