as ktvu jesse gary tells us, this is that city's first homicide of the year. >> morgan hill.tarted receiving 911 calls shortly after 7:00 wednesday morning. witnesses say gunshots were fired near the garden park apartments in the 100 block of tennent avenue. >> we hear five shots and it was really, really hard. we look at the window. it was a woman, like doing her recipe reanimation to the guy, and i think a couple minutes more, the police come. it's like a pop up everywhere. so we shut down. i see the window and that's when we see the body of the victim, morgan hill. >> police say when they arrived on scene, they found a man shot at least once in the torso. witnesses id'd suspect jesus garcia as the trigger person as he tried to escape. morgan hill detectives arrested him and charged him with committing the first homicide in this city this year. >> the two subjects were known to each other. they did have some sort of relationship with each other. >> does it seem like something sparked this violent exchange with some kind of argument or. >> yeah, we're still investigating the

morgan hill will be one of the areas seeing the heaviest amount of rainfall for a longer period of time today. so as temperatures hold steady, we're going to see waves of rain coming through with some breaks in the activity for parts of the bay area going into later today, i'll be tracking all of the changes for you. we'll talk about thanksgiving coming up. but mike, the driving conditions still a big concern even at the bay bridge. we talk about more of the rain being farther south than last week. but look, the wind blowing the flag around. as we get this to full screen, you'll see that rain actually coming down on the lands and across the roadway. a lighter volume of traffic expected, but be careful. bart says the tracks are wet, so they're slowing those trains as they typically do. standard operating procedure. now we see that road weather index showing the green across the north bay and in through the east bay as well. it's had enough time for that light rain to make those roadways pretty slick out there in many parts. look to the north. look way up here in the upper left side or th

a mushroom warehouse is in pieces after a fire in morgan hill.s morning at an office on hale and san bruno avenues. crews say it then spread to the nearby monterey mushroom warehouse, destroyed about half the warehouse. the other side is untouched. thankfully, no one was hurt. firefighters are still investigating what sparked the fire. investigators are also looking into a fire that destroyed a century old victorian home in vallejo. it started around 230 this morning at ohio and sutter streets. flames fully engulfed the home. which one tent with one tenant there learned about only when he arrived back from his thanksgiving celebrations. everyone made it out safely. no word yet on how the fire started. an incredible story of survival in the northern rockies. a camper made it out alive after spending seven weeks in the wilderness. nbc's stephanie gosk shares how he endured plummeting temperatures to find his way back. sam banaszak flashing thumbs up in a british columbia hospital. it is nothing short of miraculous that he ended up there. according

turning now to the south bay and morgan hill, the current mayor leads a challenger by a wide margin,o establish term limits also on the ballot. video here shows a watch party in downtown morgan hill as voters waited for results on those races, as well as results for school board and city council races. and we have just heard from the san jose police department and mayor mehan about the arrest of city council member omar torres. torres was arrested yesterday, will be arraigned at 130 today. torres is facing three counts of sexual assault by force of a young relative. that started when the victim and torres were both minors, but continued after torres became an adult. the investigation continues into another possible sexual assault. this is torres letter of resignation from the city council. he submitted to the san jose city clerk before he was arrested yesterday afternoon, and torres remains in the santa clara county jail awaiting his arraignment this afternoon at that time, a judge will decide whether he should be released on bail. our robert honda is tracking this story for us. we'l
